AN ORDINANCE OF THE CITY OF PORT ORCHARD,
WASHINGTON RELATING TO AND PROVIDING FOR THE
ANNEXATION OF TERRITORY TO THE CITY OF PORT
ORCHARD
WHEREAS, Russell and Kathleen All away, owners of the real
property hereinafter described, according to the assessed valuation
per general taxation, have petitioned the Council of the City of
Port Orchard that said territory be annexed to and become a part of
the City of Port Orchard; and
WHEREAS, the Kitsap County Boundary Review Board, as
required by law, has been convened and has made the determination
to not invoke jurisdiction on the matter of the proposed Allaway
Annexation; and
WHEREAS, the City Council did fix Monday, April 27, 1992
at the hour of 8:00 PM, for the Public Hearing on said petition and
the Clerk of the City of Port Orchard did give notice of said
hearing in the manner provided by law; and
WHEREAS, the City Council at their regular scheduled
meeting on the 27th day of April, 1992, did hold a hearing on said
petition and unanimously approved the same;
NOW, THEREFORE, BE IT AND IT HEREBY IS ORDAINED BY THE
COUNCIL OF THE CITY OF PORT ORCHARD, as follows:
SECTION 1. THAT the following described territory
contiguous to the City of Port Orchard be, and the same hereby is,
annexed to the City of Port Orchard and from and after the
effective date of this ordinance, May 11, 1992, shall be and become
a part of the City of Port Orchard, subject to all the laws and
ordinances thereof:
SECTION 2. THAT interim Land Use Comprehensive Plan
Designation(s) and interim Zone Classification(s) be adopted for
subject property as described as follows and does establish the
interim Comprehensive Plan Designation(s) and Zone
Classification(s) to be the closest comparable designation(s) and
classification(s) as what was established by the former
jurisdiction along with any conditions, limitations, or
restrictions applied by the former jurisdiction as though they were
part of this ordinance.

SECTION 3. THAT the Port Orchard Planning Commission
shall commence the public hearing process to establish
Comprehensive Plan Designation(s) and Zone Classification(s) for
the "Allaway Annexation" area.
LEGAL DESCRIPTION: Portion of Section135, Township 24 North, Range
1 East, W.M., described as follows: That portion of the West 110
feet of the South 485 feet of the North three quarters of the
Northwest quarter of the Southeast quarter which lies southerly of
the easterly prolongation of the following described line:
Beginning 607.3 feet south of the northeast corner of the northeast
quarter of the southwest quarter, Section 35, North 89 50' 58" west
to the east line of Sidney Road northeasterly along the easterly
line of said road 121 feet to the point of beginning of the line to
be described; thence in a southerly direction to a point 591.3 feet
south of the northeast corner of said northeast quarter of the
southwest quarter and the terminal of said line; except that
portion for Port Orchard Bypass per Auditor's File No. 8805030068;
8310250154, re -recorded under Auditor's File No. 8805030068;
situated in Kitsap County, Washington.
PASSED by the City Council of the City of Port Orchard,
signed by the Mayor and attested by the Clerk in authentication of
such passage this 27th day of Apri /1992.
