1548 - Ordinance - Rescinding Zone Classification-616 SidneyORDINANCE NO. 1548 AN ORDINANCE OF THE CITY OF PORT ORCHARD REPEALING ORDINANCE NO. 1426 AND ORDINANCE NO. 1306 TO RESCIND A ZONE CLASSIFICATION OF MULTIPLE FAMILY FOR PROPERTY LOCATED AT THE NORTHWEST CORNER OF SIDNEY AVENUE AND SWEANY STREET (616 SIDNEY AVENUE - Ron Ross). (Republished to correct clerical error.) WHEREAS, property located in the northwest corner of the Sidney Avenue Sweany Street intersection was reclassified from Residential High to Commercial General on April 22, 1985, and WHEREAS, the project as originally approved by the City Council is not complete, nor was it substantially under construction within the required 18 month time limit, and WHEREAS, the property owner has failed to meet the requirements of substantial progress as defined within Zoning Ordinance No. 1469. CONCLUSION: The City Council does therefore conclude that based upon failure to meet conditions stated within Ordinance No. 1469, Chapter 10 Section B1, which replaced Ordinance 1163, Chapter 29 Section C1, the zone reclassification of Commercial General for property located at the northwest corner of Sidney Avenue and Sweany Street should revert to Residential High. NOW, THEREFORE, be it ordained that the City of Port Orchard hereby repeals Ordinance No. 1426 and Ordinance No. 1306, and hereby reverts the zone classification for property located at the northwest corner of Sidney Avenue and Sweany Street from Commercial General to Residential High.
