AN ORDINANCE OF THE CITY OF PORT ORCHARD,
WASHINGTON AMENDING PORT ORCHARD ZONING
ORDINANCE NO. 1469; BY AMENDING THE AREA
AND USE MAPS THEREOF, RECLASSIFYING
CERTAIN PROPERTY (City of Port Orchard,
owner of record) LOCATED IN THE VICINITY
OF 1265 OLD CLIFTON ROAD, (former solid
waste landfill).
WHEREAS, The City of Port Orchard, owner of record, has
petitioned a zoning ordinance amendment, requesting reclassification
of property located in the vicinity of 1265 Old Clifton Road,
(former solid waste landfill) as described in said petition, and
WHEREAS, The City of Port Orchard Planning Commission
has transmitted to the Council of the City of Port Orchard,
Washington a copy of their Resolution No. 161-90 - ATTACHMENT "A"
recommending approval of said petition, and
WHEREAS, The Council of the City of Port Orchard did
hold a Public Hearing on January 14, 1991 to hear testimony of fact
and conclusion as follows:
FINDINGS OF FACT: The use requested is
compatible with other uses in area.
The proposed use is a permitted use within
Industrial Zoning.
CONCLUSION: Based on testimony, materials
presented and findings of fact, the Port
Orchard City Council does hereby conclude that
granting this zone reclassification would not
be detrimental to the health, safety, morals
and general welfare of the community.
NOW, THEREFORE, be it ordained that the Council
of the City of Port Orchard, Washington does hereby adopt
Planning Commission Resolution No. 161-90 with Findings of
Facts and recommended conditions as their own and does
hereby reclassify certain property from Public Property to
Industrial.
LEGAL DESCRIPTION: Situated in Section 34,
Township 24 North, Range 1 East, W.M. Commencing at the
southwest corner of said section; thence north along the west
line of said section to the northwest corner of the southwest -
quarter of the southwest quarter, thence easterly along the
north line of the southwest quarter of the southwest quarter
800 feet, which is the true point of beginning; thence
southerly along a line parallel to the west line said southwest

quarter of the southwest quarter 800 feet; thence easterly along a
line parallel to the south line of Section 34 until it intersects
with the west margin of Old Clifton Road; thence northeasterly
along the west margin of Old Clifton Road until it intersects with
the east line of the southwest quarter of said section; thence
north along the east line of the southwest quarter of the southwest
quarter; thence westerly along the north line of the southeast
quarter of the southeast quarter and the southeast quarter of the
southwest quarter to the true point of beginning.

negative impact upon adjacent land uses or the neighborhood, and
WHEREAS, the applicants have agreed to meet all conditions or.
approval required by the City, and
WHEREAS, the Bremerton-Ritsap County Health Department will review
all new development. proposals for possible health related hazards,'
and
WHEREAS, the prior use of the
potential, and operty limits its development
WE THEREFORE FIND that the proposed land use reclassification is
consistent with the development trends of the neighborhood arid. will

CCNCL'JS:CN, used on the `-indings, facts, testimony, and ,matte -la's
presented at the public hearing, we therefore conclude that a land
use reclassification from Public Property to industrial would be in
harmony with the general purposes and intent of the zoning ordinance
and surrounding comprehensive plan designations.
BE IT RESOLVED, that the Planning Commission of the City of Port
Orchard hereby respectfully requests the City Council approve a land
use reclassification of Industrial for the above described property,
subject to the following conditions:
1. Future development shall be reviewed by the City Council prior
to any development permit approval.
2. Existing trees near the site entrance shall not be removed.
3. The approval of this rezone request is dependent upon final
approval of the short plat.
4. A landscape plan shall be submitted and approved prior to any
rinal development approval.
