AN ORDINANCE OF THE CITY OF PORT ORCHARD
AMENDING CHAPTER FOUR (definitions) AND
CHAPTER TEN, SECTION B(1) OF ORDINANCE
1469 RELATING TO SPECIAL CONDITIONS FOR
LAND USE RECLASSIFICATIONS.
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD,
WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS.
SECTION 1: THAT Ordinance No. 1469, Chapter four
(definitions) is amended to include the following terms:
SITE PLAN SPECIFIC: A development plan required by this
ordinance and approved by the City Council. A site plan
is defined as including all physical and technical
drawings required by the City for project construction
and approval. Site plans shall not determine or define
the USE of property nor its occupation.
SUBSTANTIAL PROGRESS: Substantial progress may include
one or more of the following:
Proof of project financing or negotiation.
A building permit has been issued and activated.
Installation of infrastructure within the original
eighteen month time period.
A completed set of working architectural drawings.
MAJOR MODIFICATION: A major modification of a site plan
shall include any one of the following:
Any enlargement of proposed building(s).
Any site relocation of proposed building(s)
Any change in exterior
Any modification that
circulation patterns.

SECTION 2: THAT Ordinance No. 1469, Chapter Ten,
Section B, Paragraph one, Special Conditions is amended to read as
follows:
A time limit of eighteen (18) months is placed on
all rezones as provided by this ordinance. If
substantial progress toward construction of a
preapproved site plan has not occurred at the
expiration of this time period, the Council may
revoke the new land use classification or approve an
eighteen (18) month time extension with conditions.
All rezone approvals and time extensions shall
comply with the following provisions.

After proper notification of an impending
expiration date, the affected property owner
shall submit a written request for additional
time. Within 15 days failure to submit this
request will automatically cause the property to
revert back to its prior zone classification.
All land use reclassifications shall be site
plan specific. Any MAJOR modification,
deviation or departure from the original
approved site plan shall constitute a violation
of this ordinance unless the City Council has
reviewed and approved the modified site plan.
The City Council may subject modified site plans
to new conditions.
Prior approved land use reclassifications
granted time extensions may comply with all
current city development standards and
regulations, and may be subject to new
conditions of approval
The time period prescribed in this section shall
not commence until completion of any court
challenges associated with any land use
reclassification.
The development and use of property without
proper city permits shall be considered a
violation of this ordinance.
