AN ORDINANCE OF THE CITY OF PORT ORCHARD,
WASHINGTON AMENDING PORT ORCHARD ZONING
ORDINANCE NO. 1469; BY AMENDING THE AREA AND
USE MAPS THEREOF, RECLASSIFYING CERTAIN
PROPERTY (Larry A. Williams, owner of record)
LOCATED AT 4913 HOVDE ROAD.
WHEREAS, Larry A. Williams, owner of record, has
petitioned a zoning ordinance amendment, requesting reclassification
of property located at 4913 Hovde Road.
WHEREAS, The City of Port Orchard Planning Commission has
transmitted to the Council of the City of Port Orchard, Washington a
copy of their Resolution No. 171-91 - ATTACHMENT "A" recommending
denial of said petition, and
WHEREAS, The Council of the City of Port Orchard did hold
a Public Hearing on October 14, 1991 to hear testimony of fact and
conclusion as follows:
FINDINGS OF FACT: The use requested is
compatible with other uses in area.
The proposed use is a permitted use within
Commercial General Zoning.
CONCLUSION: Based on testimony, materials
presented and findings of fact, the Port Orchard
City Council does hereby conclude that granting
this zone reclassification would not be
detrimental to the health, safety, morals and
general welfare of the community.
NOW, THEREFORE, be it ordained that the Council of the
City of Port Orchard, Washington does hereby adopt Findings of Facts
as their own and does hereby reclassify certain property from
Residential Low to Commercial General to allow min -storage
warehouses, modular home display and a landscape nursery business,
with the following conditions: (1) apply for a Special Use Permit for
the mini storage warehouse, (2) provide adequate fire flow, (3) short
plat property, (4) project be site plan specific, any changes to
original site plan as presented requires Council approval, (5) no
construction on site, modular home display only, (6) A lighting plan
shall be submitted and approved prior to placement of outdoor
illumination, (7) A landscape plan shall be submitted identifying
type of materials, location and size. All landscape areas around the
site entrance and modular home shall be maintained by an automatic
sprinkler system, (8) Landscaping found dead or diseased within one
year after planting shall be replaced at the property owners expense,
(9) The access road shall be paved with asphalt or another city
approved all-weather surface, (10) A minimum six foot high fence
shall be constructed on the east and west property lines and between
the mini -storage site and the modular home display property. An

additional fence shall be constructed on the south property lines
between proposed lots 1 and 4, 2 and 3, (11) Whenever possible,
existing mature trees shall be preserved as a mature landscape
amenity during site clearing and grading, (12) the stormwater
detention system shall be designed by a licensed engineer and shall
conform to the standards of Kitsap County, (13) the stormwater system
shall receive Department of Fisheries approval, (14) the proposed
septic system shall be approved by the Health Department prior to
issuance of a building permit, (15) the applicant agrees to
participate on a proportional basis in the cost of any needed
improvements to the Hovde Road/Sidney Avenue intersection.

RECOMMENDING THE CITY COUNCIL DENY A LAND USE RECLASSIFICATION
FROM RESIDENTIAL LOW TO COMMERCIAL GENERAL FOR PROPERTY
LOCATED AT 4913 HOVDE ROAD, AS SUBMITTED BY TONY WILLIAMS; BOX
1034, GIG HARBOR, WA 98335.
LEGAL DESCRIPTION: Section 11, Township 23, Range 1E, W. 12 Rds. of
N. 10 A. of E 1/2, NW 1/4, NW 1/4.
WHEREAS, the applicant requested a land use reclassification
to commercial general for purposes of constructing modular homes,
and
WHEREAS, a public hearing was held on Monday, September 9,
1991

WHEREAS, a SEPA checklist has been submitted and received a
declaration of nonsignificance, and
WHEREAS, the proposed use of the property is considered
industrial in nature and therefore incompatible with adjacent land
uses, and
WHEREAS, a large portion of the site is not required for the
manufacture of modular homes and is not identified as to its future
use, and
WE THEREFORE FIND: that the proposed land use reclassification
is not compatible with surrounding land uses and will have a
detrimental effect on adjacent properties, and the submitted plot
plan is not specific concerning what development is proposed for a
major portion of the site.
CONCLUSION, based on the facts, testimony, and materials
presented at the hearing, we therefore conclude that the
reclassification from Residential Low to Commercial General is not
in harmony with the general purposes of the zoning ordinance and
surrounding comprehensive plan designations.
BE IT RESOLVED, that the Planning Commission of the City of
Port Orchard hereby respectfully requests that the City Council
deny a land use designation of Commercial General for the above
described property.
