ORDINANCE
AN ORDINANCE OF THE CITY OF PORT
ORCHARD REGULATING SIGNS IN THE
STREET RIGHT OF WAY.
WHEREAS, The City regulates signs and structures constructed in the
public right of way,
THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD HEREBY
ORDAINS THE FOLLOWING:
1. No sign or sign post shall be erected in the right of way
without approval from the City Council, with the following
exceptions:
A. Street signs may be placed as approved by the City
Engineer.
B. Sandwich board signs may be erected if the sign meets the
following criteria:
1. The width of the sign is a maximum of three feet.
2. The placement of the sign does not adversely affect
sight distance of vehicles in the roadway.
3. The board is not illuminated or distracting to passing
motorists.
4. The placement of the sign does not interfere with the
pedestrian's use of the sidewalk and leaves a minimum of
four feet unobstructed sidewalk width.
5. The placement of the sign does not interfere with
people entering and exiting parked vehicles and does not
extend into the street or gutter.
6. The sign is removed at night.
2. Political signs and similar campaign posters are not allowed to
be posted in the right of way.

Dear Mayor Weatherill,
This letter is regarding the proposed sandwich board ordinance. The Port
Orchard -Bay Street Merchant's Association understands the need for control of
the use of sandwich boards. However, it is imperative that merchants be allowec
to use sandwich boards to allow better visibility of the business.
The inclusion of a clause requiring merchants to add the City of Port Orchard ae
an "additional insured" presents a problem. Several merchants have contacted
their insurance companies regarding adding the City of Port Orchard as an
"additional insured" and the insurance companies have refused this request.
The Association further requests that merchants be allowed to place on the
sidewalk items such as flower pots, benches, bicycle racks, etc., providing
placement of such items is in accordance with the ordinance's requirement for
leaving at least four (4) feet of sidewalk unobstructed.
The Port Orchard -Bay Street Merchants Association fully endorses the
ordinance with the exceptions as noted above.

A revised ordinance is submitted for your review:
The terminology "required" is changed to "approved"
The placement of the sign 25 feet from the store was deleted.
Control of this allowance would become difficult if too many
people tried to place several signs at one corner.
The signs are required to be removed at night.
Insurance is required from the owner of each sign. The Clerk
is the logical one to keep the certificates and Public Works
would check with her to determine if the certificates are on
file.
Signs in violation of the ordinance would be removed and
destroyed.
The other option to the City is not to allow the signs. The
expected reaction from prohibiting the sandwich board signs is to
have the tables, chairs and bicycles challenged. If sandwich board
signs are unsafe, the business owners will probably call for
everything to be removed from the sidewalk.
