1487 - Ordinance - Rezoning PropertyORDINANCE NO. 148V`­� AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON AMENDING PORT ORCHARD ZONING ORDINANCE NO. 1469; BY AMENDING THE AREA AND USE MAPS THEREOF, RECLASSIFYING CERTAIN PROPERTY (Doug Eide, owner of record) LOCATED AT 528 and 534 DEKALB STREET. WHEREAS, Doug Eide, owner of record, has petitioned a zoning ordinance amendment, requesting reclassification of property located at 528 and 534 DeKalb Street as described in said petition, and WHEREAS, The City of Port Orchard Planning Commission has transmitted to the Council of the City of Port Orchard, Washington a copy of their Resolution No. 147-90 - ATTACHMENT "A" recommending approval of said petition, and WHEREAS, The Council of the City of Port Orchard did hold a Public Hearing on May 14, 1990 continued to May 29, 1990 to hear testimony of fact and conclusion as follows: FINDINGS OF FACT: The use requested is compatible with other uses in area. The proposed use is a permitted use within Multiple -Family 20 Zoning. CONCLUSION: Based on testimony, materials presented and findings of fact, the Port Orchard City Council does hereby conclude that granting this zone reclassification would not be detrimental to the health, safety, morals and general welfare of the community. NOW, THEREFORE, be it ordained that the Council of the City of Port Orchard, Washington does hereby adopt Planning Commission Resolution No. 147-90 with Findings of Facts and recommended conditions as their own and does hereby reclassify certain property from Residential -High to Multiple -Family 20. LEGAL DESCRIPTION: Lots 9, 12, 13 and the West 20 feet of Lot 16, Block 2 Plat of "S.M. Stevens" Township plat of Sidney. Section 26, Township 24 N, Range 1 E, W.M. WHEREAS, the applicant has requested a rezone to Multiple -Family 20 in order to construct eleven (11) dual level condominiums with garages beneath the living area on a parcel located at 528 & 534 Dekalb Street, and WHEREAS, a public hearing was held on Monday, 16 April 1990, and the Planning Commission considered the findings of facts, the testimony and material presented at the hearing, and WHEREAS, a SEPA checklist has been submitted and has received a declaration of non -significance, and WHEREAS, the Comprehensive Plan designation of the property is Commercial -General on the west parcel and Residential -High on the east parcel, and WHEREAS, the neighborhood is a mixture of residential and commercial uses, and WHEREAS, apartment units and condominiums are permitted uses within the Multiple -Family 20 zoning district, and WHEREAS, the site for the proposed development is adequate in size and shape to accommodate said use, and WHEREAS, the applicant has agreed to comply with conditions of approval needed to mitigate the impacts of their proposed development. WE THEREFORE FIND: that a rezone from Residential -High to Multiple -Family 20 is consistent with the development in the neighborhood. CONCLUSION: Based on the findings of facts, the testimony and materials presented at the public hearing, we therefore conclude that a zone reclassification from Residential -High to Multiple - Family 20, would be in harmony with the general purposes and intent of the zoning ordinance and comprehensive plan. BE IT RESOLVED, that the Planning Commission of the City of Port L Attachment "A" Ordinance No. 1487 Orchard hereby respectfully requests that the City Council approve a zone reclassification from Residential. -High to t Multiple -Family 20 in order to be allowed to ccnstruct eleven 1 (11) dual level condominiums with garages beneath the living area on a parcel located at 528 & 534 Dekalb Street, subject to the conditions of approval that: 1. The property owner provide a soils analysis, a topographic survey and a storm hydrologJ analysis before issuance of a building permit. 2. The property owner/developer provide a traffic study to determine the safest and best location for ingress and egress. 3. The property owner/developer install a curbed landscaped area along Dekalb Street between the two access points.
