HomeMy WebLinkAbout1453 - Ordinance - Comp Plan Map DesignationORDINANCE NO. 1453;/ AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON AMENDING CITY OF PORT ORCHARD COMPREHENSIVE PLAN ORDINANCE NO. 895; BY AMENDING THE COMPREHENSIVE PLAN MAP CERTAIN PROPERTIES THEREIN THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DOES ORDAIN AS FOLLOWS: WHEREAS, A.W. Price and Leonard Minor, owners of record, have initiated a comprehensive plan ordinance amendment requesting redesignation of property described in said petition, and all legal requirements have been performed; and WHEREAS, the City of Port Orchard Planning Commission has transmitted to the Council of the City of Port Orchard their findings and recommendations, Planning Commission Resolution No. 111-88 (ATTACHMENT "A") NOW, THEREFORE, BE IT ORDAINED, that the City Council of the City of Port Orchard does hereby adopt the findings and recommendations of the Port Orchard Planning Commission as it's own and does hereby redesignate certain property on the Comprehensive Plan Map from Kitsap County designation of Semi -Urban to City of Port Orchard Residential Low and all areas within 200' of the creek have been designated Green -Belt. LEGAL DESCRIPTION - ATTACHMENT "B" PASSED by the City Council of the City of Port Orchard, APPROVED by the Mayor and attested by the Clerk in authentication of such passage this 27th day of February, 1989. I3EI.OW DESCRIBED PROPERTY, AND AITROVH A DESIGNATION OF RESIDENTIAL - LOW AND CRCCN BEET ON THE COMPREHENSIVE PLAN MAP. LEGAL DESCRIPTION: "Thar portion of the SW ]/'I, NC 1/4, the NC 1/4, SW 1/4 & NW 1/4, SC 1/4, Section 02, 'Township 23 North, Range 01 Cast, W.M., described as follows: Beginning 600 feet south and 30 feet east of the northwest corner of the southwest 1/4, northeast 1/4; thence west about 721 feet to the center of Blackjack Creel:; thence southerly along said Creel: to where it intersects with the north line of the northwest 1/4, southeast 1/4, said Section 02; thence east to a point that is 495 feet east of the northwest corner of the southeast 1/4 of Section 02; thence south 420 feet; thence west to the center of Blackjack Creel:; thence northerly along the centerline of Blackjack Creel: to where it intersects with the west line of the northwest 1/4, southeast 1/4; thence north along said west line to the southwest corner of the northeast 1/4 of Section 2; thence continue north along the west line of the northeast 1/4, 720 feet; thence east 30 feet to point of beginning. WHEREAS, on May 31, 1988 the City Council received a Notice of Intent to Petition for Annexation into the City of Port Orchard From A. W. Price, Mary Price and Leonard Minor for their properties, and WHEREAS, Washington State Annexation Law provides that cities may prepare corn prehensive land use plans to become effective upon annexation for areas adjacent to the corporate limits, and WHEREAS, as a condition of acceptance of this annexation petition, the City Council requires the simultaneous adoption of a Comprehensive Plan Designation for the subject property, and WHEREAS, the applicants have requested the City designate their property Residential -Low on the Comprehensive Plan in conjunction with the annexation of their properties into the City of Port Orchard, and WHEREAS, a public hearing was held on 21 November 1988 and that the Planning Commission considered the findings of facts, the testimony and material presented at the hearing, and WHEREAS, a SCPA checklist has been submitted and has received a declaration of non -significance, and WHEREAS, the present county zoning of the property is R-5 Mll, which is comparable to the City's Residential -Low zoning district, and WHEREAS, no new or different uses are anticipated for these parcel that would not be allow under the present zoning designation, and WHEREAS, the neighborhood is semi -rural in nature with single-family residences and unimproved acreage, and WIICREAS, due to the sensitivity of Blackjack Creel: all areas within the City limit and within 200' of the creel: have been designated Green -Belt WE THEREFORE FIND: that a comprehensive plan designation of Residential -Low and Green Belt would be consistent with City policy and will not be detrimental to existing uses in the neighborhood. CONCLUSION: Based on the findings of facts, the testimony and materials presented a[ the public hearing, we therefore conclude that a comprehensive plan designation of Residential-l-ow and Green Belt, would be in harmony with the general Purposes and intent of the zoning ordinance and comprehensive plan. BE rl' RESOLVED, that the Planning Commission of the City of Port Orchard hereby respectfully requests that the City Council approve a designation of Residential - Low and Green Belt for those areas located within 200 feet of Blackjack Creel: on the City,s Comprehensive Plan Map for the above described property, upon annexation.
