AN ORDINANCE OF THE CITY OF PORT ORCHARD,
WASHINGTON ADOPTING THE NORTHWEST ENERGY
CODE AND REPEALING PORT ORCHARD ORDINANCE
NO. 1337
WHEREAS, the City of Port Orchard is supportive of
conservation of natural resources by reducing electrical demand, and
WHEREAS, the City desires to maintain consistency in
building codes by enforcing the same uniform codes as those in Kitsap
County,
THEREFORE, the City Council of the City of Port Orchard
does hereby ordain:
SECTION 1. The Washington State Energy Code (2nd Edition),
as promulgated by the State Building Code Council shall set forth minimum
requirements for the design of new buildings and structures and additions
and remodels to existing building and structures, subject to the following
qualifications;
A. The Northwest Energy Code, June 1987, edition
("Complete Code Version"), as published by the Bonneville Power
Administration, shall be in effect with respect to:
New residential construction using electrical
heating; and
New Commercial construction using electrical space
conditioning and electric lighting.
EXCEPTION: a. Commercial
buildings which are not
electrically space conditioned
shall only be required to comply
with Section 505 of said
Northwest Energy Code
(Electrical Power and Lighting).
EXCEPTION: b. All Commercial
buildings shall meet the
requirements in Section 305 of
the Washington State Energy Code
(ventilation).
All buildings constructed after the effective date
of this ordinance that are subsequently converted
to electrical space heating or conditioning, in
part or in whole.

B. Section 502.1.7.2 of the Northwest Energy Code shall
apply to all low rise R-1 and R-3 occupancies regardless of fuel source.
C. The Northwest Energy Code shall not become effective
until 30 days subsequent to the date that the City and the Bonneville
Power Administration have executed a grant agreement, pursuant to the

to the Bonneville Power Administration Northwest Energy Code Program
Solicitation DE-PS79-89BP93000; provided, however, in no event shall the
effective date be sooner than January 1, 1990.
SECTION 2. That Ordinance No. 1337 is hereby repealed.
PASSED by the City Council of the City of Port Orchard,
signed by the Mayor and attested by the Clerk in authentication of such
passage this 13th day of November, 1989.
