ORDINANCE NO. 1476
AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON
AMENDING PORT ORCHARD ZONING ORDINANCE NO. 1163; BY
AMENDING THE AREA AND USE MAPS THEREOF,
RECLASSIFYING CERTAIN PROPERTY (Kitsap County,
owners of record) LOCATED AT 611, 613, 614, 617, 619
DIVISION STREET; 704, 712, 716 SIDNEY AVENUE; 651
AND 707 TAYLOR STREET.
WHEREAS, Kitsap County, owners of record, have petitioned a
zoning ordinance amendment, requesting reclassification of property located
at located at 611, 613, 614, 617, 619 Division Street; 704, 712, 716 Sidney
Avenue; 651 and 707 Taylor Street as described in said petition, and
WHEREAS, The City of Port Orchard Planning Commission has
transmitted to the Council of the City of Port Orchard, Washington a copy of
their Resolution No. 129-89 - ATTACHMENT "A" recommending approval of said
petition, and
WHEREAS, The Council of the City of Port Orchard did hold a
Public Hearing on October 23, 1989 to hear testimony of fact and conclusion
as follows:
FINDINGS OF FACT: The use requested is not incompatible with
other uses in area.
The proposed use is a permitted use within Public Poperties.
CONCLUSION: Based on testimony, materials presented and findings
of fact, the Port Orchard City Council does hereby conclude that
granting this zone reclassification would not be detrimental to
the health, safety, morals and general welfare of the community.
NOW, THEREFORE, be it ordained that the Council of the City of
Port Orchard, Washington does hereby adopt Planning Commission Resolution No.
129-89 with Findings of Facts and recommended conditions as their own and
does hereby reclassify certain property from Residential High and Commercial
General to Public Properties, with following condition of prohibiting any
additional ingress or egress on Sidney Avenue.
LEGAL DESCRIPTION: Section 26, Township 24 N, Range 1 E,
W.M., Sidney S.M. Stevens' Addition, Block 5, Lot 2, 3, 6, 7 &
10 and Sweany's Addition to Sidney Lots 1 to 12 Block 1; also
Lots 1 to 5, Block 2; also Lots 1 to 5 and the N 10 ft of Lot
9 and all Lot 10 Blook 3; also Lots 2 to 9 Blcok 4, including
all vacated roads; also Lot 1 and 10 to 12, Block 4; also Lot
7, 8 and the south 40 feet of Lot 9, Block 3; Kitsap County,
Washington.

A RESOLUTION BY THE PORT ORCHARD PLANNING
COMMISSION RECO:NLMENDING THAT THE CITY COUNCIL
APPROVE A ZONE RECLASSIFICATION FRO;;M RESIDENTIAL -
HIGH AND COMMERCIAL -GENERAL TO PUBLIC PROPERTIES
ON THE BELOW DESCRIBED PROPERTY, KNOWN AS THE
KITSAP COUNTY COURTHOUSE COMPLEX.
LEGAL DESCRIPTION: Section 26, Township 24 N, Range 1 E, N.M.: Sidney S.M.
Stevens' Addition, Block 5, Lots 2, 3, 6, 7 & 10 and Sweany's Addition to Sidney
Lots 1 to 12 Block 1; also Lots 1 to 5 Block 2; also Lots 1 to 5 & the N 10 ft
Lot 9 and all Lot 10 Block 3; also Lots 2 to 9 Block 4, including all vacated
roads; also Lot 1 & lots 10 to 12 Block 4; also Lot 7, 8 and the south 40 feet of
Lot 9, Block 3; Kitsap County, Washington.
WHEREAS, the applicant has requested a rezone from Residential -High and
Commercial -General to Public Properties in order that properties belonging to
Kitsap County and enjoying a public use, be rezoned to a Public Properties
designation in order to bring them into conformance with the City's Zoning
Ordinance. The properties are located at: 611, 613, 614, 617, 619 Division; 704,
712 716 Sidney, 651 and 707 Taylor. These properties are considered to be within
the Kitsap County Courthouse complex,and
WHEREAS, a public hearing was held on 19 June 1989 and that the Planning
Commission considered the findings of facts, the testimony and material presented
at the hearing, and
WHEREAS. a SEPA checklist has been submitted and has received a declaration of
non -significance, and
WHEREAS, the property is zoned Public Properties on the Comprehensive Plan Map,
and
WHEREAS, when the existing zoning ordinance was first adopted the City did not
have a Public Properties Zoning District, and
WHEREAS, the purpose of the Public Properties zoning district is to identify and
to designate all properties owned and used by the general public within the City
of Port Orchard.
WE THEREFORE FIND: that the zone reclassification to Public Properties, is
desirable for the development of the community, meets the purpose and intent of
the Zoning Ordinance and in the public interest.

CONCLUSION: Based on the findings of facts, the testimony and materials
presented at the public hearing, we therefore conclude that a designation of
Public Properties on the property described above and known as the Courthouse
Complex, would be in harmony with the general purposes and intent of the zoning
ordinance and comprehensive plan.
BE IT RESOLVED, that the Planning Commission of the City of Port Orchard hereby
respectfully requests that the City Council approve the zone reclassification from
Residential -High and Commercial -General to Public Properties on the above
described property located at: 611, 613, 614, 617, 619 Division; 704, 712 716
Sidney; 651 and 707 Taylor.
