AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON
AMENDING PORT ORCHARD ZONING ORDINANCE NO. 1163; BY
AMENDING THE AREA AND USE MAPS THEREOF,
RECLASSIFYING CERTAIN PROPERTY (Kitsap County,
owners of record) LOCATED AT 503, 507, 511 and 513
AUSTIN AVENUE.
WHEREAS, Kitsap County, owners of record, have petitioned a
zoning ordinance amendment, requesting reclassification of property located
at located at 503, 507, 511 and 513 Austin Avenue as described in said
petition, and
WHEREAS, The City of Port Orchard Planning Commission has
transmitted to the Council of the City of Port Orchard, Washington a copy of
their Resolution No. 132-89 - ATTACHMENT "A" recommending approval of said
petition, and
WHEREAS, The Council of the City of Port Orchard did hold a
Public Hearing on October 23, 1989 to hear testimony of fact and conclusion
as follows:
FINDINGS OF FACT: The use requested is not incompatible with
other uses in area.
The proposed use is a permitted use within Public Poperties.
CONCLUSION: Based on testimony, materials presented and findings
of fact, the Port Orchard City Council does hereby conclude that
granting this zone reclassification would not be detrimental to
the health, safety, morals and general welfare of the community.
NOW, THEREFORE, be it ordained that the Council of the City of
Port Orchard, Washington does hereby adopt Planning Commission Resolution No.
132-89 with Findings of Facts and recommended conditions as their own and
does hereby reclassify certain property from Residential High and Commercial
General to Public Properties, with following conditions: 1) The rezone be
site plan specific; 2) the County install an 8 inch water main on Division
Street from Sidney Avenue to Cline Avenue and one hydrant with storz coupling
to provide adequate fireflow; 3) fifteen parking spaces of off street parking
be designated for public parking to exclude employee parking; 4) concrete
sidewalks on both sides of Division Street from Sidney Avenue to Austin
Avenue along both sides of Austin Avenue and Dwight Street be constructed; 5)
the height of the building can exceed 33 feet if adequate fire fighting
provisions are included and approved by the City Fire Chief.

East, W.M., Plat of Sidney S.M. Stevens', Block 18, Lots 1, 2,
3 and 4. Located within Kitsap County, Washington.

A RESOLUTION BY THE PORT ORCHARD PLANNING
COMMISSION RECOMMENDING THAT THE CITY COUNCIL
APPROVE A ZONE RECLASSIFICATION FROM RESIDENTIAL -
HIGH AND COMMERCIAL -GENERAL TO PUBLIC PROPERTIES
ON THE BELOW DESCRIBED PROPERTIES, BELONGING TO
KiTSAP COUNTY, LOCATED AT 503, 507, 511, AND
513 AUSTIN.
LEGAL DESCRIPTION: Section 26, Township 24 North, Range 1 East, W.M., Plat of
Sidney S. M. Stevens', Block 18, Lots 1, 2, 3 and 4. Located within Kitsap
County, Washington.
WHEREAS, Kitsap County has requested a zone reclassification from Residential -
High and Commercial -General to Public Properties in order that properties located
at 503, 507, 311 and 513 Austin be incorporated into the courthouse complex, and
WHEREAS, a SEPA checklist has been submitted and has received a declaration of
non -significance, and
WHEREAS, a public hearing was held on 21 August 1989 and that the Planning
Commission considered the findings of facts, the testimony and material presented
at the hearing, and
WHEREAS, the proposed uses for property are public agencies, social sevices
program and future construction of a public works building, and
WHEREAS, Kitsap County has shown a need for expansion of the courthouse complex,
and
WHEREAS, Kitsap County is developing a Master Plan for expansion and development
of the County complex, and
WHEREAS, has demonstrated how the proposed zone reclassification to public
properties is consistent with their proposed master plan, and
WHEREAS, the purpose of the Public Properties Zoning District is to identify and
to designate all properties owned and used by the general public within the City
of Port Orchard.
WE THEREFORE FIND: that a zone reclassification to Public Properties on the above
described properties, is desirable for the development of the community, meets the
purpose and intent of the Zoning Ordinance and is in the public interest.

CONCLUSION: Based on the findings of facts, the testimony and materials
presented at the public hearing, we therefore conclude that a zone reclassification
from Residential -High and Commercial -General to Public Properties, would be in
harmony with the general purposes and intent of the zoning ordinance and
comprehensive plan.
BE II' RESOLVED, that the Planning Commission of the City of Port Orchard
hereby respectfully requests that the City Council approve the zone reclassification
from Residential -High and Commercial -General to Public Properties for properties
located at 503, 507, 511 and 513 Austin.
