AN ORDINANCE OF THE CITY OF PORT
ORCHARD, WASHINGTON AMENDING CITY OF
PORT ORCHARD COMPREHENSIVE PLAN
ORDINANCE NO. 895; BY AMENDING THE
COMPREHENSIVE PLAN MAP CERTAIN
PROPERTIES THEREIN
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD,
WASHINGTON, DOES ORDAIN AS FOLLOWS:
WHEREAS, Daniel and Barbara Case, owners of
record, have initiated a comprehensive plan ordinance
amendment requesting redesignation of property described in
said petition, and all legal requirements have been
performed; and
WHEREAS, the City of Port Orchard Planning
Commission has transmitted to the Council of the City of Port
Orchard their findings and recommendations (Attachment "A")
that the Comprehensive Plan Map be amended for the reasons
stated therein;
NOW, THEREFORE, BE IT ORDAINED, that the City
Council of the City of Port Orchard does hereby adopt the
findings and recommendations of the Port Orchard Planning
Commission as it's own and does hereby redesignate certain
property on the Comprehensive Plan Map from Kitsap County
designation of Residential -Low to Multiple Family 20.

RECOMMENDING THAT, THE CITY COUNCIL ADOPT A COMPRE-
HENSIVE PLAN DESIGNATION OF MULTIPLE -FAMILY 20,
SIMULTANEOUS WITH THE ACCEPTANCE OF THE ANNEXATION
PETITION SUBMITTED BY DANIEL AND BARBARA CASE.
LEGAL DESCRIPTION: THAT PORTION OF THE WEST 700.00 FEET OF
GOVERNMENT LOT 1, SECTION 26, TOWNSHIP 24 NORTH, RANGE 1 EAST
W.M., LYING SOUTH OF STATE HIGHWAY NO. 14 (Sign Route No. 160) AND
SOUTH OF WILKINS DRIVE BEING MORE PARTICULARLY DESCRIBED AS
FOLLOWS: BEGINNING AT THE SOUTHWEST CORNER OF SAID GOVERNMENT LOT

WHEREAS, on 14 September 1987 the City Council received a Notice
of Intent to Petition for Annexation into the City of Port Orchard
from Daniel and Barbara Case, etal. As a condition of acceptance
of this annexation petition, the City Council is requiring the
simultaneous adoption of a Comprehensive Plan Designation for the
subject property, and
WHEREAS, a public hearing was held on 19 October 1987 and that the
Planning Commission considered the findings of facts, the testimony
and material presented at the hearing, and
WHEREAS, this is a non -project action for the annexation of the
property into the City and a comprehensive plan designation, and
WHEREAS, The present County zoning for the property is R5-M11. The
zoning designation for the property if it is annexed will be
residential -low, which also allows 5 units per acre, and
WHEREAS, A SEPA checklist has been submitted and received a
declaration of non -significance.
WE THEREFORE FIND: The Comprehensive Plan designation requested
by the applicant is less dense than presently allowed by the
County's Comprehensive Plan. The residential density will not be
changed by the annexation of this property.
CONCLUSION: Based on the findings of facts, the testimony and
materials presented at the public hearing, we therefore conclude
that a Comprehensive Plan designation of Multiple -Family 20, would
be in harmony with the general purposes and intent of the zoning
ordinance and comprehensive plan.
BE IT RESOLVED, that the Planning Commission of the City of Port
Orchard hereby respectfully requests that the City Council
designate the above described property as Multiple -Family 20,
simultaneously with the acceptance of the annexation petition.
