AN ORDINANCE OF THE CITY OF PORT
ORCHARD REPEALING ORDINANCE NO. 1158
AND ESTABLISHING A REQUIREMENT FOR
ADDITIONAL RIGHT OF WAY FROM
COMMERCIAL DEVELOPMENTS.
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD,
WASHINGTON, DOES ORDAIN AS FOLLOWS:
SECTION 1. Ordinance No. 1158 of the City of
Port Orchard is hereby repealed.
SECTION 2. As a condition to reclassify land use
to commercial use or to obtain a special use permit for
property along Bethel Avenue from the south property line of
the Vista Motel (1090 Bethel Avenue) to the south City
limits, the property owner shall dedicate the front length of
the property, twenty (20) feet wide, to the City of Port
Orchard. This property shall allow for the eventual widening
of Bethel Avenue.
SECTION 3. The property shall be dedicated to
the City after approval of the land use reclassification by
the City Council, but before the pertinent ordinance is
passed.
SECTION 4. If the property reverts back to
residential use after the property is dedicated to the City,
the City shall not release the dedication.
PASSED by the City Council of the City of Port
Orchard, APPROVED by the Mayor and attested by the Clerk in
authentication of such passage this 28th day of March, 1988.
