1426 - Ordinance - Amending ZoningORDINANCE NO. 1426 AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON AMENDING PORT ORCHARD ZONING I cL by' ls4$ ORDINANCE NO. 1306 AND ORDINANCE NO. GrQrr 1163; BY AMENDING THE AREA AND USE MAPS THEREOF, RECLASSIFYING CERTAIN PROPERTY (Ron Ross, owner of record) LOCATED ON THE NORTHWEST CORNER OF SIDNEY AVENUE AND SWEANY STREET SECTION 1: That Ordinance No. 1306 and Ordinance No. 1163 are amended to read as follows: WHEREAS, Ron Ross, owner of record has petitioned a zoning ordinance amendment, requesting reclassification of property located on the northwest corner of Sidney Avenue and Sweany Street, as described in said petition, WHEREAS, The City of Port Orchard Planning Commission has transmitted to the Council of the City of Port Orchard, Washington a copy of their Resolution No. 052-85 recommending approval of said petition, and WHEREAS, The Council of the City of Port Orchard did hold public hearings on March 11, 1985 and April 8, 1985 as required to hear testimony and review materials presented and does set forth findings of fact and conclusion as follows: FINDINGS OF FACT: The property adjacent on the south and west are Zoned Commercial General, the property adjacent on the north is zoned Residential High. The proposed use of the property is not incompatible with other uses in area. CONCLUSION: Based on testimony, materials presented and findings of fact, the Port Orchard City Council does hereby conclude that granting this zone reclassification would not be detrimental to the health, safety, morals and general welfare of this community. NOW THEREFORE, be it ordained that the Council of the City of Port Orchard does hereby reclassify certain property (described as follows) from Residential High to Commercial General with the following conditions: 1. That the site plan submitted be made an integral part of the zone reclassification. 2. That a time limit of twelve months (from the effective date of this Ordinance) be placed on the rezone. Upon expiration of that time (June 13, 1989), if a project that is a permitted use within the new zoning classification has not commenced or construction is not substantially underway, the property shall revert to its prior classification. An extension of said time limit may be granted by the Council upon demonstration of cause by the applicant.
