1371 - Ordinance - Sewer Rates<G� )((6-6— 50RDINANCE NO. 1371 AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON AMENDING ORDINANCE NO. 1294, S1; ORDINANCE NO. 1250, S1; ORDINANCE NO. 1106, ORDINANCE NO. 1075, ORDINANCE NO. 947, AND ORDINANCE NO. 817 (CHAPTER 13.08 OF THE PORT ORCHARD MUNICIPAL CODE) THE CITY COUNCIL OF THE CITY OF PORT ORCHARD DOES ORDAIN AS FOLLOWS: 1. THAT Section 1 of Ordinanace No. 947, as last amended by Ordinance No. 1294 (Section 13.08.190 of Port Orchard Municipal Code) be amended to read as follows: '13.08.190 Sewer Rates. The following flat rates per month are established for the classifications of users indicated below within the city limits, which rates shall become effective and charges beginning March 1, 1985. (1) Class I, separate family residence (including mobile homes on private property) whether occupied or not; fourteen dollars ($14.00) per month per unit; (2) Class II, business, commercial, and professional service: a basic fee of fourteen dollars ($14.00) per month, plus fifty cents ($.50) per employee over three, plus the following per month: (A) An amount of ten dollars and fifty cents ($10.50) per establishment containing heavy -use public restrooms, i.e., open to the public and readily available. (B) An amount of eight dollars and fifty cents ($8.50) per establishment containing moderate -use public restroom, i.e., not open to the general public but readily available for use of customers. (C) An amount of six dollars and fifty cents ($6.50) per establishment containing light -use public restrooms, i.e., available if asked. (D) An additional amount for unusual or extra heavy useage, such amount to be determined by the City Council. (3) Class III, churches, a monthly charge of fourteen dollars ($14.00); (4) Class IV, hotels, rest homes, motels and auto courts; a monthly charge of nineteen dollars ($19.00) plus three dollars and eighty cents ($3.80) per unit. (5) Class V, apartments (including duplexes, triplexes, mobile home parks, condominiums, etc.): fourteen dollars ($14.00) for each living unit. (6) Class VI, public and private schools; seventy cents ($.70) per month per each pupil, teacher, maintenance and administrative personnel; (7) Class VII, Kitsap County Courthouse: four hundred dollars ($400.00) per month. (8) In those instances where vacancies occur in Class I or Class II and V, the following applies: Ordinance No. 1371 Page Two (A) Upon proper application, the Treasurer shall have the authority to make a billing adjustment of ten dollars ($10.00) on the basic sewer service charges for any full month in which an individual unit is vacant for such calendar month. (B) The property owner must complete the appropriate application within the first ten days following each calendar month period of vacancy to be eligible for a billing adjustment of the sewer service charges. No sewer service charges shall be adjusted on a pro -rated basis. (C) Vacant properties will be subject to periodic inspections. Any person who knowingly submits an application containing false information shall be charged a penalty twice the sewer service rate for that period for which sewer service was credited. Any person charged such a penalty may appeal the imposition of the penalty to the City Council within fifteen (15) days of the penalty assessment.
