AN ORDINANCE OF THE CITY OF PORT
ORCHARD, WASHINGTON ESTABLISHING
POLICIES TO DETERMINE THE FEES IN
LIEU OF ASSESSMENT FOR WASTEWATER
TREATMENT FACILITIES.
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD,
WASHINGTON, DOES ORDAIN AS FOLLOWS:
SECTION 1. All property to receive sewer
service, that was not included within the boundaries of
U.L.I.D. No. 1, shall pay a fee in lieu of assessment for the
wastewater treatment facilities, in addition to other
applicable utility fees.
SECTION 2. The fee in lieu of assessment shall
be based on the same formula used to compute assessments for
U.L.I.D. No. 1 and shall be computed by the City Engineer and
approved by the City Clerk.
SECTION 3. The City Engineer shall determine the
appropriate land use for purposes of calculating the fee in
lieu of assessment based on zoning and building permit
information. Water consumption will be estimated by the City
Engineer comparing the water consumption of similar
businesses in other locations.
SECTION 4. Vacant properties will not be allowed
to participate in this fee in lieu of assessment charge until
the properties' planned use is determined by either zoning
reclassification or building permits.
SECTION 5. Any property owner aggrieved by the
calculation of the fee in lieu of assessment may file a
written appeal to the City Council.
PASSED by the City Council of the City of Port
Orchard, APPROVED by the Mayor and attested by the Clerk in
authentication of such passage this 24th day of August, 1987.
