AN ORDINANCE OF THE CITY OF PORT ORCHARD
AMENDING PORT ORCHARD ZONING ORDINANCE NO.
1163; BY AMENDING THE AREA AND USE MAPS
THEREOF, RECLASSIFYING CERTAIN PROPERTY
(Frank Christen, owner of record) LOCATED
NORTH OF TREMONT AND WEST OF CANYON COURT
(Known as Cedar Canyon Division 2 and 3)
WHEREAS, Frank Christen, owner of record, has
petitioned a zoning ordinance amendment, requesting reclass-
ification of property located North of Tremont and West of
Canyon Court (known as Cedar Canyon Division 2 and 3), as
described in said petition, and
WHEREAS, The City of Port Orchard Planning
Commission has transmitted to the Council of the City of
Port Orchard, Washington a copy of their Resolution No.
056-85 recommending approval of said petition, and
WHEREAS, The Council of the City of Port Orchard
did hold Public Hearings on June 10, 1985 and July 22, 1985
to hear testimony and review materials presented and does
set forth findings of fact and conclusion as follows:
FINDINGS OF FACT: The use requested is not
incompatible with other uses in area.
The proposed use is a permitted use within
Residential High Zoning.
CONCLUSION: Based on testimony, materials
presented and findings of fact, the Port Orchard
City Council does hereby conclude that granting
this zone reclassification would not be
detrimental to the health, safety, morals and
general welfare of the community.
NOW, THEREFORE, be it ordained that the Council of
the City of Port Orchard does hereby reclassify certain
property (Legal Description -Attachment "A") from Residential
Low to Residential High with the following conditions:
1) That all preliminary Plat requirements have
been completed and/or final plat approval
granted within 36 months or the land reverts
to residential low.
2) That sidewalks be constructed on the West
and South side of street.
3) That roadway be constructed as per "Typical
Roadway Section, Cedar Canyon Estates,
Divisions 2 and 3." (Attachment "B")
4) That a covenant be recorded with the Plat
that would restrict the Plat to allow either
one single-family dwelling or one duplex per
lot.

5) That the Preliminary Plat map be bound to
rezone.
PASSED by the City Council and APPROVED by the
Mayor of the City of Port Orchard this 9th day of September,
1985.
