AN ORDINANCE OF THE CITY OF PORT
ORCHARD ESTABLISHING PROCEDURES FOR
ENFORCEMENT AND CERTAIN PENALTIES FOR
VIOLATIONS OF THE PORT ORCHARD ZONING
ORDINANCE.
THE CITY OF PORT ORCHARD DOES ORDAIN AS FOLLOWS:
Section 1. Enforcement. It shall be the duty of
the City Engineer to see that Ordinance No. 1163 and
amendments thereto codified as the Port Orchard Zoning
Ordinance is enforced through proper legal channels. No
permit for the construction or alteration of any building or
part thereof shall be issued unless the plans, specifications
and intended use of such building conform in all respects to
the Port Orchard Zoning Ordinance.
Section 2. Violation and Penalties.
(a) It shall be unlawful and a violation of
Ordinance No. 1163 and amendments thereto codified as the
Port Orchard Zoning Ordinance for any person to use or occupy
any portion of any premises, any part of which has been
constructed, equipped or is used in violation of the
provisions of the Port Orchard Zoning Ordinance, until such
unlawful use has ceased and such unlawful construction and
equipment has been removed. Any premises which have been
constructed, equipped or used in violation of the Port
Orchard Zoning Ordinance shall be posted with a sign
directing the vacation of the entire premises within ten (10)
days from the date noted thereon. Any person removing such
sign without the permission of the proper authority shall be
guilty of a misdemeanor, and will be subject to the penalties
provided in this ordinance.
(b) Any person, firm or corporation who
violates, disobeys, omits, neglects or refuses to comply with
or who resists the enforcement of any of the provisions of
the Port Orchard Zoning Ordinance shall be deemed guilty of a
misdemeanor and shall be fined in any sum not more than five
hundred ($500.00) dollars, or imprisonment in the City jail
for a term not to exceed ninety (90) days, or by both such
fine and imprisonment, for each offense. Each ten (10) days
that a violation is permitted to exist shall constitute a
separate offense.
PASSED by the City Council of the City of Port
Orchard, APPROVED by the Mayor and attested by the Clerk in
authentication of such passage this 8th day of July, 1985.
