1326 - Ordinance - Amending Ordinance No. 895 Comprehensive Plan MapORDINANCE NO. 1326 AN ORDINANCE OF THE CITY OF PORT ORCHARD AMENDING CITY OF PORT ORCHARD COMPREHENSIVE PLAN ORDINANCE NO. 895; BY AMENDING THE COMPREHENSIVE PLAN MAP CERTAIN PROPERTIES THEREIN THE CITY COUNCIL OF THE CITY OF PORT ORCHARD DOES ORDAIN AS FOLLOWS: WHEREAS, Robert Roland and Howard Roland, Inc. owners of record, have initiated a comprehensive plan ordinance amend- ment requesting redesignation of property described in said petition, and all legal requirements have been performed; and WHEREAS, the City of Port Orchard Planning Commission has transmitted to the Council of the City of Port Orchard their findings and recommendations (Attachment "A") that the Compre- hensive Plan Map be amended for the reasons stated therein; NOW, THEREFORE, BE IT ORDAINED, that the City Council of the City of Port Orchard does hereby adopt the findings and recommendations of the Port Orchard Planning Commission as it's own and does hereby redesignate certain property on the Compre- hensive Plan Map from Residential Low to Commercial General. LEGAL DESCRIPTION: SW 1/4, NW 1/4, section 11, township 23 north, range 1 east, W.M.M.; except portion of county road, except road and except state highway. LESLIE WEATHERILL, MAYOR ATTEST: �P tricia Hower, City Clerk APPROVED AS TO FORM: ty Cler J ORDINANCE NO. 1326 Attachment "A" CITY OF PORT ORCHARD PLANNING COMMISSION RESOLUTION NO. 64-85 A RESOLUTION BY THE PORT ORCHARD PLANNING COMMISSION RECOMMENDING THAT THE CITY COUNCIL APPROVE A CHANGE IN THE COMPREHENSIVE PLAN ON THE SOUTHWEST CORNER OF SEDGWICK AND SR#16 TO COMMERCIAL - GENERAL AS REQUESTED BY ROLAND & ROLAND. LEGAL DESCRIPTION: SE 1/4, NW 1/4 EXCEPT SOUTH 15 RODS SECTION 11, TOWNSHIP 23 NORTH, RANGE 1 EAST, W.M.; EXCEPT PORTION EAST OF COUNTY ROAD, EXCEPT ROADS, AND EXCEPT HIGHWAY. WHEREAS, the applicant has requested a change in the Compre- hensive Plan map designation of Commercial -Highway to Commercial - General in order to construct a commercial shoppings center, and WHEREAS, a public hearing was held on 16 September 1985 and that the Planning Commission considered the findings of facts, the testimony and material presented at the hearing, and WHEREAS, we find that an Environmental Impact Statement was prepared for this project and accepted by the City in 1978 which has addressed all the environmental concerns and mitagation measure, and WHEREAS, A SEPA checklist has been prepared and received a declaration of non -significance because no new environmental concerns are present and the original EIS is still relevant, and WHEREAS, the City has zoned the southeast corner of Sedgwick and SR416 Commercial -General and the northwest corner has been zoned Commercial -Highway, and WHEREAS, commercial shopping centers are permitted uses within the Commercial -General zoning district HEREP'ORE FIND: That a change in the Comprehensive Plan map designation to Commercial -General would be in the public interest. CONCLUSION: Based on the findings of facts, the testimony and materials presented at the public hearing, we therefore conclude that the granting of the requested change in the Comprehensive Plan would be in harmony with the general purposes and intent of the zoning ordinance and the City's long range plan. BE IT RESOLVED, that the Planning Commission of the City of Port Orchard hereby respectfully requests that the City Council approve the change as requested. PASSED this 16 day of September 1985.
