AN ORDINANCE DECLARING
THE NEED FOR CONDEMNATION
OF PARCELS OF LAND IN
AND THROUGH CERTAIN
REAL PROPERTY FOR THE
PURPOSE OF CONSTRUCTING
THE PORT ORCHARD BY-PASS
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD DOES
ORDAIN AS FOLLOWS:
Section 1. That for the public health, safety and
welfare of the citizens of the City of Port Orchard, said city
has entered into a project to construct the Port Orchard By -Pass
and has caused to be prepared general and specific plans
therefor.
Section 2. To accomplish the said project, it is
necessary to acquire a portion of the real property and permanent
slope easement described on Exhibit A, incorporated herein.
Section 3. The City Attorney is hereby authorized
and directed to proceed immediately with the condemnation of the
above -described property in the Superior Court for the State of
Washington at Kitsap County.
Section 4. The subject property will by paid for
in part through use of general funds of the city, and through
federal and state grant loans.
PASSED by the City Council and APPROVED by the
Mayor this 14th day of May 1984.

35, Township 24 North, Range 1 East, W.M., in
Kitsap County, Washington, described as
follows:
Beginning at the Southwest corner of the
intersection of Tremont Street and Sidney
Avenue which is also the True Point of
Beginning; thence Westerly 45 feet along the
south margin of Tremont Street; thence
easterly along a curve which is described by a
radius of 35 feet whose center of curvature is
southwest of said curve and a chord of 41
feet, more or less to a point of intersection
on the west margin of Sidney Avenue; thence
northerly 25 feet along the west margin of
Sidney Avenue to the True Point of Beginning.

Beginning at the Southwest corner of the
intersection of Tremont Street and Sidney
Avenue which is the True Point of Beginning;
thence westerly 123 feet along the southern
margin of Tremont Street; thence south 3 feet;
thence easterly 80 feet along a line parallel
to and 3 feet south of the southern margin of
Tremont Street; thence southeasterly along a
curve described by a chord of 45 feet more or
less and a radius of 35 feet whose center of
curvature is southwest of said curve to the
insection with the west margin of Sidney
Avenue; thence northerly 44 feet along the
west margin of Sidney Avenue to the True Point
of Beginning; except for the following parcel:
Beginning at the Southwest corner of the
