AN ORDINANCE OF THE CITY OF PORT ORCHARD
AMENDING THE USE AND AREA MAPS OF
ORDINANCE NO. 1163: RECLASSIFYING CERTAIN
PROPERTY (Leslie & Debra Harper, owners of
record) LOCATED AT 2475 BETHEL ROAD
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD
DOES HEREBY ORDAIN AS FOLLOWS:
Section 1. THAT that the area and use maps of
Ordinance No. 1163 be and hereby are amended (as petitioned
by Leslie and Debra Harper, owners of record) to conform
with Chapter 10 as follows:
Legal Description: Attachment "A"
BE AND THE SAME IS HEREBY reclassified from
Residential Low to Commercial General subject to all
conditions as set forth in Port Orchard Planning Commission
Resolution No. 046-84 (Attachment "B")
PASSED by the City Council and APPROVED by the
Mayor of the City of Port Orchard this 8th day of October,

HARPER REZONE
LEGAL DESCRIPTION: Part of the northwest quarter of the southwest quarter of
Section 36, Township 24 north, Range I east, W.M., described as follows: From a
point on the west line of the northwest quarter of the southwest quarter, said point
lying 50 rods northerly from the southwest corner thereof; running thence easterly
on a line that lies parallel with and 50 rods north of the south line of said northwest
quarter of the southwest quarter to a point on the west marginal line of County Road
No. 9, otherwise known as Mitchell Road; thence north 8020' east 141.65 feet; thence
south 89°20' west 161.35 feet to a point which is identical with the southwest corner
of a tract conveyed to J. Haas in Volume 265 of deeds on page 242, as Auditor's
File No. 314129, said point being the true point of beginning; thence north 2032,301,
east 109.76 feet to the northwest corner of said Haas tract; thence south 88022' West
to the west line of the northwest quarter of the southwest quarter ; thence southerly
along said west line to a point that bears south 89°20' west from the true point
of beginning; thence north 89020' east to the true point of beginning; EXCEPT a strip

RESOLUTION NO. 046-84
A RESOLUTION BY THE CITY OF PORT ORCHARD PLANNING COMMISSION
RECOMMENDING THAT THE CITY COUNCIL APPROVE A REZONE TO
COMMERCIAL GENERAL, AS REQUESTED BY LESLIE & DEBRA HARPER.

WHEREAS, the applicant has requested a zone reclassification in order to allow
a professional office in an existing residence, and
WHEREAS, a public hearing was held on 20 August 1984, and that the Planning
Commission considered the findings of facts, the testimony and material presented
at the hearing....
FINDINGS OF FACTS
A SEPA Checklist was submitted and received a declaration of non -significance.
The present zone classification is residential -low.
The proponents have requested a zone reclassification to commercial -general.
The Comprehensive Plan Map designation for the site is commercial general.
The site for the intended use is adequate in size and shape to accomodate
the proposed use.
Off-street parking as shown is adequate for the proposal.
Utilities are available and adequate for the proposed use.
WHEREAS, the granting of a rezone to commercial -general would be in conformance
with the objectives of the Comprehensive Plan, and
WHEREAS, the granting of this rezone will not be detrimental to the public health,
safety, or welfare or injurious to property and improvements in the vicinity.
CONCLUSION: Based on the findings of facts, the testimony and materials presented
at the public hearing, we therefore conclude that the granting of the rezone as
requested, to be in harmony with the general purposes and intent of the zoning
ordinance and comprehensive plan.
BE IT RESOLVED; that the Planning Commission of the City of Port Orchard hereby
respectfully requests that the City Council approve the zone reclassification from
residential -low to commercial general, based on the findings of facts and subject
to the following condition of approval:
CONDITION OF APPROVAL: That agreements, concomitant with the rezone,
be signed and recorded, securing to the City the right to construct and assess
for; a sewermain, watermain with hydrants and road improvement needed to
mitagate the impacts of the commercial development.
