AN ORDINANCE AMENDING
ORDINANCES 1242 SECTION 1 AND
1125 SECTION 2 (CHAPTER 9.02 - GENERAL
PROVISIONS - CRIMINAL CODE) AND ADDING
A NEW CHAPTER UNDER TITLE 9 ENTITLED
DOMESTIC VIOLENCE PROTECTION
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD DOES ORDAIN AS
FOLLOWS:
Section 1. That Port Orchard Municipal Code Section
9.02.040 is hereby amended to read as follows:
9.02.040 Violation -- Penalty. Except as otherwise
ifiq ospecifically provided in this title, any person who commits,
attempts to commit, conspires to commit or aids or abets or is an
accomplice in, or who falsely, fraudulently or otherwise causes,
coerces, requires or directs other to commit acts declared by
this title to be a crime shall be guilty of a misdemeanor and
upon conviction shall be punished by a fine not to exceed five
thousand dollars, or imprisonment not to exceed one year, or by
both such fine and imprisonment.
Section 2. That a new chapter be added to Title 9 of
the Port Orchard Municipal Code:

Section 3. That a new section be added to the Domestic
Violence Prevention Act which reads as follows:
Violation of a Civil Protection Order -
a. Willful violation of the following provisions of a Civil
Protection Order is a misdemeanor:
1. Restraining any party from committing acts of
domestic violence;
2. Restraining any party from having contact with the
other party;
3. Excluding any party from the residence of the other
party;
4. Restraining any party from interfering with the
other party's custody of children;
5. Restraining any party from removing the children
from the jurisdiction of the court or out of the state.
b. For the purpose of this Section, a Civil Protection Order
means a Temporary Civil Protection Order or a Civil Protection
Order issued pursuant to the 1984 Domestic Violence Prevention
Act.
Section 4. That a new section be added to the Domestic
Violence Prevention Act which reads as follows:
Violation of a Criminal No Contact Order -
a. Willful violation of a court order prohibiting a defendant

from having contact with the victim(s) of domestic violence is a
misdemeanor.
b. For the purpose of this Section, victim(s) means the spouse,
ex -spouse, relative by Flood or marriage, housemate or roomate
and ex-housemate or ex-roomate the defendant allegedly committed
a crime of domestic violence against. Domestic violence
includes, but is not limited to, the crimes of assault, reckless
endangerment, coercion, burglary, criminal trespass, malicious
mischief, kidnapping and unlawful imprisonment.
Section 5. Severability - If any provision of this
ordinance or its application to any person or circumstance is
held invalid, the remainder of the ordinance or the application
of the provision to other persons or circumstances is not
affected.
