ORDINANCE NO. 1249 ✓
AN ORDINANCE approving and confirming the assess-
ments and assessment roll of omitted properties within
Utility Local Improvement District No. 1, and levying
and assessing a part of the cost of carrying out
certain betterments to and extensions of the water-
works utility against the several lots, tracts,
parcels of land and other properties shown on the roll
of omitted properties; and amending the Exhibit A to
Ordinance No. 1231 in order to correct an error.
WHEREAS, by Ordinance No. 1231, adopted April 11, 1983, the
City Council of the City of Port Orchard (the "City") estab-
lished Utility Local Improvement District No. 1 ("ULID No. 10)
in order to pay part of the cost of certain additions, exten-
sions and betterments to the City's Waterworks Utility (the
"Improvements") and
WHEREAS, by Ordinance No. 1237, adopted July 25, 1983, the
City Council approved and confirmed the assessments and assess-
ment roll of ULID No. i; and
WHEREAS, a technical error in the legal description of ULID
No. 1, contained in Exhibit A to Ordinance No. 1231, caused the
omission from ULID No. 1 of a small number of properties
specially benefited by the Improvements; those properties,
listed at Exhibit A to this ordinance (incorporated here by this
reference), were therefore omitted from the assessment roll
approved and confirmed by Ordinance No. 1237; and
WHEREAS, the Superior Court of the State of Washington for
Kitsap County, by Order dated August 5, 1983, in Cause Nos.
83-2-00529-1 and 83-2-00581-9, found at paragraph 18 that "[t]he
City should be allowed to correct the legal description of ULID
No. 1 and proceed with any supplemental reassessment proceedings
that may be required"; and
WHEREAS, the legal description. of ULID No. 1 contained at
Exhibit C (incorporated here by reference) represents the
correct legal description of ULID No. 1; and
WHEREAS, the owners of certain properties within ULID No.
1, listed at Exhibit B to this ordinance (incorporated here by
this reference), were not given notice of the proceedings
relating to ULID No. 1 as required by law and were therefore
omitted from the assessment roll approved by Ordinance No. 1237
of the City; and
WHEREAS, RCW 35.44.360 through 35.44.380 provide a proce-
dure for assessments on omitted properties; and
WHEREAS, the assesssment roll levying the special assess-
ments against the omitted properties located in Utility Local
Improvement District No. 1 in the City of Port Orchard,
Washington (the "City"), and listed on Exhibits A and B. has
been filed with the City Treasurer as provided by law; and
WHEREAS, notice of the time and place of hearing thereon
and making objections and protests to the roll was duly pub-
lished at and for the time and in the manner provided by law
fixing the time and place of hearing thereon for the 2nd day of
November, 1983, at the hour of 10:00 a.m., local time, at the
Active Club in Port Orchard, Washington, before a Special
Committee of the City Council (the "Committee"), and further
notice thereof was duly mailed by the City Clerk to each prop-
erty owner shown on the roll; and
WHEREAS, at the time and place fixed and designated in the
notice the hearing was held, all protests were considered and
all persons wishing to be heard were heard, and the Committee
determined to recommend to the City Council the assessment roll
of the omitted properties; and
WHEREAS, the City Council received the report of its
Committee, and, on November 14, 1983, sitting and acting as a

Board of Equalization for the purpose of considering the roll of
omitted properties and the special benefits to be received by
each lot, parcel and tract of land shown upon such roll, deter-
mined to accept the report of the Committee and overruled all
protests; and
WHEREAS, after considering alternative methods of assess-
ment, the City Council has determined that the method used to
compute assessments, and the assessment roll itself, fairly
reflect the special benefits to the properties to be assessed;
NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON,
DO ORDAIN as follows:

properties in Utility Local Improvement District No. 1, which
has been created and established for the purpose of carrying out
the plan of additions and betterments and extension of the
waterworks utility of the City specified and adopted by Ordi-
nance No. 1220 of the City, as provided by Ordinance No. 1231,
shall be and the same are in all things and respects approved
and confirmed in the total amount of $34,815.00.
Section 2. Each of the lots, tracts, parcels of land and
other property shown upon the roll of omitted properties is
determined and declared to be specially benefited by this
improvement in at least the amount charged against the same, and
the assessment appearing against the same is in proportion to
the several assessments appearing upon the roll. There is
levied and assessed against each lot, tract, parcel of land and
other property appearing upon the roll the amount finally
charged against the same thereon.
Section 3. The assessment roll as approved and confirmed
shall be filed with the City Treasurer for collection and the
Treasurer is authorized and directed to publish notice as

required by law stating that the roll is in her hands for
collection and payment of any assessment thereon or any portion
of the assessment can be made at any time within thirty days
from the date of the first publication of such notice without
penalty, interest or cost, and that thereafter the sum remaining
unpaid may be paid in 20 equal annual installments with interest
thereon estimated to be 10% per annum with the exact interest
rate to be fixed in the ordinance authorizing the issuance and
sale of water and sewer revenue bonds to be supported in part by
assessments levied in Utility Local Improvement District No. 1.
The first installment of assesssments on the assessment roll of
omitted properties shall become due and payable during the
thirty -day period succeeding the date one year after the date of
first publication by the City Treasurer of notice that the
assessment roll is in her hands for collection and annually
thereafter each succeeding installment shall become due and
payable in like manner. If the whole or any portion of the
assessments remains unpaid after the thirty -day period, interest
upon the whole unpaid sum shall be charged at the rate as
determined above, and each year thereafter one of the install-
ments, together with interest due on the unpaid balance, shall
be collected. Any installment not paid prior to the expiration
of the thirty -day period during which such installment is due
and payable shall thereupon become delinquent. All delinquent
installments shall be subject to a charge for interest at the
rate specified above and for an additional charge of 10% penalty
levied upon both principal and interest due upon such install-
ment or installments. The collection of such delinquent
installments will be enforced in the manner provided by law.

Section 4. Exhibit A to Ordinance No. 1231 is hereby
amended to read as does Exhibit C to this ordinance.
