1199 - Ordinance - Amending Ordinance 851 by Imposing Sales or Use TaxORDINANCE NO. 1199 AN ORDINANCE OF THE CITY OF PORT ORCHARD AMENDING ORDINANCE NO. 851 BY IMPOSING ADDITIONAL SALES OR USE. TAX AND ADDING SPECIAL INITIATIVE PROCEDURE AND DECLARING AN EMERGENCY (Port Orchard Municipal Code 5.80) THE COUNCIL OF THE CITY OF PORT ORCHARD DO ORDAIN AS FOLLOWS: Section 1. Ordinance No. 851, Subsection 2, (Municipal Code Chapter 5.80) is hereby amended to read as follows: �Z�a2 A,�d,A 5.80.020 RATE. Pursuant to RCW 82.14.030, subsection (1), there shall be imposed a tax of one-half of one percent of the selling price in the case of a sales tax or value of the article used in case of a use tax; provided, however, that during such period as there is in effect a sales or use tax imposed by the county, the rate of tax imposed pursuant to RCW 82.14.030 subsection (1) shall be four hundred and twenty-five one -thousandths of one percent.. Pursuant to RCW 82.14.030 subsection (2) there shall be imposed an additional sales and use tax of one-half of one percent of the selling price in the case of a sales tax or value of the article used in case of a use tax effective July 1, 1982. Section 2. Ordinance No. 851, Subsection 2, (Municipal Code Chapter 5.80) is hereby amended to read as follows: 5.80.030 ADMINISTRATION. The administration and collection of the tax imposed by this chapter shall be in accordance with the provisions of RCW 82.14. Section 3. Ordinance No. 351 (Municipal Code Chapter 5.30) is hereby amended by adding a new section to read as follows: 5.80.060 INITIATIVE PROCEDURE A special initiative procedure shall subject the additional sales or use tax pursuant to RCW 82.14.030 subsection (2) as adopted by the City to approval or rejection by the voters. The special initiative procedure shall be in accordance with the provisions of RCW 35A.11.100. Section 4. Ordinance No. 851 (Municipal Code Chapter 5.80) is hereby amended by adding a new section to read as follows: 5.80.070 EMERGENCY. This ordinance is necessary for the immediate preservation of the public peace, health and safety and the support of the municipal government and shall take effect immediately.
