1201 - Ordinance - Amending Ordinance 1162 Commence Construction Within a Specific Time LimitORDINANCE NO. 1201 ✓ AN ORDINANCE OF THE CITY OF PORT ORCHARD AMENDING ORDINANCE NO. 1162 (Condition No 3) RELATIVE TO REQUIREMENT TO COMMENCE CONSTRUCTION WITHIN A SPECIFIC TIME LIMIT THE CITY COUNCIL OF THE CITY OF PORT ORCHARD DO ORDAIN AS FOLLOWS: SECTION 1: That Ordinance No. 1162 (Condition No 3) is hereby amended to read as follows: Section l: That the use and area maps of Ordinance No. 899 be and hereby are amended (as petitioned by Illiad, Inc., William H. Evans, Jr., owner of record) to conform with Chapter 10 as follows: LEGAL DESCRIPTION: (see attached description) be and the same is hereby reclassified from Residential Low (RL) to Commercial General (CG) subject to the following conditions: A. Planning Commission's Facts of Finding as submitted to Port Orchard City COUncil and adopted as their own. B. Additional conditions as set forth by City Council as follows: 1. Owner may obtain domestic and fire flow water from Annapolis Water District contingent upon owner signing an agreement with the City of Port Orchard stating owner, heirs and/or it's assigns will hook-up to Port Orchard water at such time as adequate fire flow and domestic water is accessible to their property located at 1730-1750 SR160. Owner must also agree to pay all applicable fees at time of hooking up to City of Port Orchard Water. 2. Ingress/egress may be directly onto SR160 at the easterly boundary provided owner extend two-way left turn lane the length of property at his own expense. 3. That a time limit of thirty-six (36) months be placed on the rezone. Upon expiration of that time (May 11, 1984) if a project that is a permitted use within the new zoning classification has not commenced or construction is not substantially underway, the property shall revert to its prior classification. An extension of said time limit may be granted by the Council upon demonstration of cause by the applicant. Ordinance No Page 2 1201 4.
