1207 - Ordinance - Establishing Chapter 11 MotorcyclesV O ORDINANCE NO. 1207 / AN ORDINANCE OF THE CITY OF PORT ORCHARD ESTABLISHING CHAPTER 11 (PORT ORCHARD MUNICIPAL CODE) AND ADDING NEW SECTIONS THEREOF. THE COUNCIL OF THE CITY OF PORT ORCHARD DO ORDAIN AS FOLLOWS: SECTION 1. There is hereby established Chapter 11 City of Port Orchard Municipal Code and shall be known as "Miscellaneous Rules and Regulations". SECTION 2. That the following sections be added as new sections to Chapter 11.04 of the City of Port Orchard Municipal Code: Section 11.04.010 Persons under sixteen operating motorcycles on private property -unlawful: It .is unlawful for any person under sixteen years of age to operate a motor- cycle on private property zoned for residential use in the city, unless the operator resides as a permanent resident upon that lot, tract or parcel upon which the motorcycle is being operated. (a) This section shall not be applicable to a guest of a lawful resident of said lot, tract or parcel who is operating a motorcycle owned by the lawful resident of the lot, tract or parcel. (b) Property zoned for residential use, as herein used, shall be defined as property zoned residential district RL, RH, MF-20, OS AND GB. Section 11.04.020 Persons under sixteen operating motorcvcles on private property -Violation -Impoundment. In the event of the violation of Section 11.04.010, the police department shall have the right to impound the motorcycle involved in the violation for a period of not more than seventy-two (72) hours to ascertain and investigate ownership of the vehicle and possessory rights therein and the occupants thereof. To secure a release of the motorcycle, the police department shall be entitled to reimbursement for all reasonable expenses incurred in impounding the motorcycle and the storage thereof; provided, however, such expense shall not exceed the sum of twelve dollars ($12.00) per impoundment. Section 11.04.030 Gas powered vehicle-Mufflinq device required. It is unlawful for any person to operate any gas -powered vehicle in the city without an operating muffling device which shall effectively blend the exhaust and motor noise so as to preclude excessive or unusual noise. For the purposes of this section, any noise isexcessive which is in excess of eighty-two decibels on the "A" scale at one hundred feet in accordance with the testing procedures established by the Washington State Patrol. 0A 50 Y 1t`" ,"S;� �IRI Section 11 04 040 Unnecessary noise from motor vehicles prohibited. It is unlawful for any person to cause unnecessary noise to emanate from any motor vehicle either upon the public streets or parked in reasonably close proximity thereto within the corporate limits of Port Orchard. Such shall include but not be limited to unnecessary engine noise, the unnecessary tooting or honking of horns or other noise - making devices and unreasonably loud noise em,^ating from radios, tape recorders or other such devices located in or on such motor vehicle. Section on private propert and unnecessary vehicle noise - Aiding or abetting vioia unlawful. It is unlawful for any person to aid or abet i the violation of Sections 11.04.010 through 11.04.040. Section 11.04.060 Use of coasters, roller skates and similar devices restricted. (a) No person upon roller skates, or riding in or by means of any coaster, toy vehicle, or similar device, shall go upon any roadway except while crossing a street on a crosswalk, and when so crossing, such person shall be granted all of the rights and shall be subject to all of the duties applicable to pedestrians. This section shall not apply upon any street during the period such street is set aside for a lawful parade or similar function. (b) It is unlawful to tow any person upon any device described in subsection (a) behind a motor vehicle within the city limits except at a lawful parade or similar function. Section 11.04.070 Applicability of traffic code to places other than public highways_,_ streets and alleys. The provisions of RCW 46.61.445, 46.61.500, 46.61.506 and 46.61.525 shall be applicable to all motor vehicles operators and all motor vehicles operated on any private roadway open to public use, any private parking area to which the public is invited or permitted, and any publicly owned or maintained place where motor vehicles are allowed to travel.
