087-13 - West Sound Utility District - ContractINTERLOCAL AGREEMENT Contract No. 087-13 WEST SOUND UTILITY DISTRICT AND THE CITY OF PORT ORCHARD MODIFYING THE WATER UTILITY RETAIL SERVICE AREA BOUNDARIES IN ACCORDANCE WITH THE KITSAP COUNTY COORDINATED WATER SYSTEM PLAN PREAMBLE This interlocal agreement modifies the water utility retail service area between West Sound Utility District and the City of Port Orchard. WHEREAS, the Kitsap County Coordinated Water System Plan applies to both the City of Port Orchard and West Sound Utility District (formerly known as Annapolis Water District); and WHEREAS, designation of retail service areas, together with the cooperation of adjacent water utilities, will help ensure that time, effort and funds are best used by avoiding unnecessary duplication of service; and WHEREAS, on June 16, 1998, the parties entered into an Interlocal Agreement establishing the retail service area boundaries for which each party assumed retail water service responsibilities, which was amended by the parties on July 28, 2009; and WHEREAS, the City of Port Orchard and West Sound Utility District have determined that it is in the public's best interest to make adjustments to their retail service boundaries; NOW, THEREFORE, The undersigned parties, having authority granted by the City Council of the City of Port Orchard and the Board of Commissioners of West Sound Utility District, hereby enter into this Agreement by their signatures on behalf of their respective municipalities. Section 1. Boundary Adjustment. The City of Port Orchard and West Sound Utility District hereby agree to make the following adjustments to the water utility retail service area boundary. The below tax parcels are hereby transferred from the water retail service area of the City of Port Orchard to the water retail service area of West Sound Utility District: Tax Account Number: 352401-4-006-2002 Legal Description: BEGINNING 297 FEET EAST AND 630 FEET NORTH OF THE SOUTHWEST CORNER OF THE SOUTHWEST QUARTER OF THE SOUTHEAST QUARTER, SECTION 35, TOWNSHIP 24 NORTH, RANGE 1 EAST, W.M.; THENCE RUNNING NORTH 315 FEET; THENCE EAST 693 FEET; THENCE SOUTH 315 FEET; THENCE NORTH 693 FEET TO THE PLACE OF BEGINNING; EXCEPTING Interlocal Agreement to Mods Water Retail Service Areas Page 1 of 2 THEREFROM THE FOLLOWING DESCRIBED TRACT: BEGINNING AT THE NORTHEAST CORNER OF THE ABOVE DESCRIBED PROPERTY; THENCE S1*04'S4 W A DISTANCE OF 20.50 FEET ALONG THE EAST LINE OF SAID PROPERTY; THENCE N38*08'10 W A DISTANCE OF 26.83 FEET TO THE NORTH LINE OF SAID PROPERTY; THENCE S87*55'56 E A DISTANCE OF 16.97 FEET ALONG SAID NORTH LINE TO THE TRUE POINT OF BEGINNING OF THIS EXCEPTION, AS CONVEYED TO CITY OF PORT ORCHARD. Area: 4.91 acres Section 2. Service Continuity. This property to be transferred is undeveloped; therefore, water service continuity will not be affected. Section 3. Attachment.
