A RESOLUTION OF THE CITY OF PORT ORCHARD
APPROVING THE ISSUANCE OF A SPECIAL USE
PERMIT TO PARAGON, INC. FOR A SPECIFIC
USE OF A PARCEL OF PROPERTY WHICH IS IN
HARMONY WITH THE VARIOUS ELEMENTS OR
OBJECTIVES OF THE COMPREHENSIVE PLAN
AND IS NOT DETRIMENTAL TO EXISTING USES
PERMITTED IN THAT PARTICULAR ZONE
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD DOES
HEREBY RESOLVE:
THAT: Whereas, the City Planning Commission has
held the required public hearings in accordance with the
criteria set forth in Chapter 5 (Special Use Permits) of
Ordinance No. 1163, Zoning Ordinance of the City of Port
Orchard, and
WHEREAS, the City Planning Commission has
recommended approval of the application of Paragon, Inc.
and has recorded planning Commission Resolution No. 034-83
with the City Clerk setting forth their findings and
recommendations for conditional of approval.
NOW, THEREFORE, the City Council of the City of Port
Orchard does hereby approve that a Special Use Permit be
issued in accordance with conditions imposed by Ordinance No.
1163, Chapter 5 and the following additional conditions:
(1) That a written agreement be made regarding
landscaped screening, between the owner of the subject
property and the owner of the adjacent property to the north.
(2) That the parking lot be paved.
(3) That the sidewalk be replaced.-
(4) That a time limit of eighteen (18) months be
place on issuance of Special Use Permit. Upon expiration of
that time (July 9, 1985) if the project has not commenced or
construction is not substantially underway, the property shall
revert to its prior classification.
LEGAL DESCRIPTION: Beginning at a point 799 feet
south of the northwest corner of the southeast quarter of the
southeast quarter, Section 26, Township 24 North, Range 1 East
W.M.; thence south 132 feet; thence east 330 feet; thence north
132 feet; thence west 330 feet to the place of beginning, except
the east 185 feet and any portion thereof lying within Sidney St.
