047-19 - Port Orchard Police Guild - Contract Amendment MOU 5MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF PORT ORCHARD AND TI IE PORT ORCHARD POLICE GUILD (REPRESENTING THE SERGEANT EMPLOYEES) It is understood and agreed that the City of Port Orchard (City) and Port Orchard Police Guild (Guild) enter into the following Memorandum of Understanding (MOU) related to the promotion of an employee out of the bargaining unit. WHEREAS, the City's current Deputy Chief is retiring as of December 31, 2020; and WHEREAS, the Police Chief has offered the position of Deputy Chief to an employee covered under the Guild contract; and WHEREAS, the Guild contract addresses the handling of leaves upon separation of employment from the City; and WHEREAS, the Guild contract is silent on the handling of leaves upon a promotion out of the bargaining unit; and WHEREAS, both parties wish to address these topics for this employee; and WHEREAS, the handling of leaves upon leaving the bargaining unit while remaining a City employee will be a topic during the negotiation of the successor contract between the parties; NOW THEREFORE, the City and the Guild have entered into this Memorandum of Understanding ("MOU") to handle the leave banks of Sergeant Donna Main upon promotion to the position of Deputy Chief on January 3, 2021, as follows: Sick Leave. As provided for in Article 12.1.2.1 of the current CBA relating to employees separating from the City, the City will deposit the cash value of up to 400 hours of accrued but unused sick leave into Ms. Main's HRA VEBA account. Additionally, any accrued but unused leave in excess of 400 hours as of January 3, 2021, will be placed into Ms. Main's sick leave bank as of her first day as Deputy Chief. 2. Holidav Leave. As provided for in Article 10.5 of the current CBA relating to employees separating from the City, the City will cash out up to 96 hours of accrued but unused Holiday Leave to Ms. Main. 3. Vacation Leave. Article 11.6 of the current CBA allows Ms. Main to carry over up to 240 hours of Vacation Leave from one calendar year to the next. Upon promotion to Deputy Chief, the City will place any accrued but unused leave available to her as of January 3, 2021, up to a maximum amount of 240 hours, into Ms. Main's vacation leave bank as of her first day as Deputy Chief.
