A RESOLUTION OF THE CITY OF PORT ORCHARD,
INITIATING PROCEEDINGS TO VACATE A CERTAIN
PORTION OF KITSAP STREET AND AN ALLEY NORTH
OF KITSAP STREET.
BE IT RESOLVED BY THE CITY COUNCIL of the CITY OF PORT ORCHARD,
as follows:
(1) That it is the intention of the CITY OF PORT ORCHARD
to initiate proceedings to vacate the following -described street
and alley within the City of Port Orchard:
Kitsap Street, from Bethel Avenue
East 166.07 feet measured along the
south r/w line, the alley south of
Kitsap Street from the eas-t r/w of
Highway 160 to the easterly property
line of Lot 6, Block 6, WHEELER'S
ADDITION, and alley north of
Kitsap Street from the east r/w
of Highway 160 to the easterly
property line of Lot 10, Block 5,
WHEELER'S ADDITION, in Kitsap County,
Washington;
SUBJECT TO the CITY OF PORT ORCHARD
retaining an easement fifteen (15) feet
wide (7-1/2 feet on each side of the
centerline) of alley so vacated, and
5 feet wide along the east side of
Lot. 6, Block 6, and Lot 10, Block 5,
WHEELER'S ADDITION;
FURTHER SUBJECT TO ROBERT GANNS, his
successors, personal representatives
and assigns, assuming liability for
all damages arising out of slides or
other earth movement attributable to
the removal of earth from the vacated;
street, alleys or private property.
(2) That Monday, the 8th day of December, 1969, at the
hour of 7:30 o'clock PM at the Council Chambers, Port Orchard
City Hall, Port Orchard, Washington, is the time and place
fixed for hearing on said Petition.
PASSED by the CITY COUNCIL and approved by the Mayor
this 27th day of October, 1969.
