RESOLUTION NO. 1068
A RESOLUTION of the City Council of the City of
Port Orchard, Washington, declaring its intention
to carry out the system or plan providing for
additions to and betterments of the waterworks j
utility of the City of Port Orchard, Washington,
as adopted by Ordinance No. 806, passed July 8,
1968, and to create a local improvement district
to assess a part of the cost and expense of carry-
ing out said system or plan or additions to and
betterments of the waterworks system, all to
become a part of the waterworks utility of the
City, against the properties within the local
improvement district proposed to be created
specially benefited thereby, and notifying all
persons who may desire to object to said improve-
ment to appear and present their objections at a
meeting of the City Council to be held on October
14, 1968.
WHEREAS, the City of Port Orchard, Washington, by Ordinance
No. 806, passed by the City Council and approved by the Mayor
on the 8th day of July, 1968, specified and adopted a plan of
additions to and betterments of the waterworks system of the
City, all to become a part of the waterworks utility of the City,
consisting of the construction and installation of a ten -inch
cast iron water main from the intersection of Sidney Avenue and
Lippert Drive, westerly to Pottery Avenue, thence southerly to
a point approximately 30 feet south of the southerly boundary of
the Francis Fuller property and eight fire hydrants (six-inch
intake) at approximately 300 foot intervals for the length of
the aforesaid main, estimated the total cost of said additions
to and betterments of the waterworks system to be $30,000.00,
and provided that payment therefor would be -made (a) from
assessments to be levied in the amount of not to exceed
$18,356.00 against the property specially benefited by the.
proposed improvement and included in a local improvement
district to be thereafter formed, and (b) from surplus funds

of the City of Port Orchard in the amount of $11,644.00; and
WHEREAS, the City Council of the City of Port Orchard deems
the aforesaid improvements necessary for the protection o the
public health and safety and that it is in one best interests
of the City that said plan providing for additions to and better-
ments of the waterworks system of the City be carried out,: and

that a local improvement district be created to assess a part of

the cost and expense thereof; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON,
DO ORDAIN, as follows:
Section 1. It is the intention of the City Council''of the
City of Port Orchard, Washington, to order the carrying out of
the system or plan providing for additions to and bettermnts
of the waterworks system of the City, all to become a part of the
waterworks utility of the City, as adopted by Ordinance No. 806,
consisting of the acquisition, construction, and installation of
a ten -inch cast iron water main from the intersection of Sidney
Avenue and Lippert Drive, westerly to Pottery Avenue, thence
southerly to a point approximately 30 feet south of the southerly
boundary of the Francis Fuller property, and eight fire hydrants
(six-inch intake) at approximately 300 foot intervals for the
length of the aforesaid main, together with all necessary valves,
fittings, and appurtenances, the nature and territorial extent
of such improvement being more particularly described in Section 1
of Ordinance No. 806, which Section is by this reference incor-
porated herein and made a part hereof. The boundaries of such
proposed local improvement district are more particularly
described as follows:
Beginning at the NE corner, Section 3-23-1 E;
thence southerly along the E line of said section
571.15; thence N 88'01'58" W 1267.29' to a point

on the Ely margin of Prim. State Hwy No. 14;
thence SEly along said 'highway margin to a point
which is 130' from the south line of the NE 1/4,
NE 1/4 of said section 3, measured at right angles
to said subdivision line; thence Ely along a line
parallel to and 130' from said subdivision line
to the east line of said section 3; thence Ely
along a line parallel to and 130' from the south
line of NW 1/4 of the NW 1/4 of section 2-23-1E
to a point 150' from the west line of said section
2; thence northerly along a line parallel to and
150' from said west line of section to a point
which is 120' south of the south margin of Lippert
Drive; thence easterly along a line which is
parallel to and 120' from the said street margin
to a point which is 120' from the westerly margin
of Sidney Street measured at right angl.;s to Sidney
Street, thence NEiy along a line parallel to and
120' from the westerly margin of Sidney Street to
a point which is 120' from the north margin of
Lippert Drive measured at right angles from Lippert
Drive; thence Wly along a line which is parallel
to and 120' from the north margin of said street
to a point which is 755.0' from the west line of
said section 2; thence N3113'07" E 504.72' to 'the
N line of said section 2; thence westerly along
said section line 754.88' to the NW corner of said
section the point of beginning; Situated in Kitsap
County, Washington.
Section 2. The improvement shall be constructed and
installed in accordance with the plans and specifications therefor
to be prepared by Hammond, Collier and Isaac, consulting engineers
to the City.

Section 3. Not to exceed $181356.00 of the cost and
expense of carrying out said system or plan shall be borne by
and assessed against the property specially benefited by such
improvement to be included in the local improvement district to
be established embracing as near as may be all property specially
benefited by such improvement and with the proposed boundaries
as set forth above. The balance of the cost and expense of said
improvement shall be paid from surplus funds of the City of
Port Orchard.
Section 4. All persons who may desire to object to the
improvement herein mentioned are hereby notified to appear and

present such objections at a meeting of the City Council to be
held in the Council Chambers in the City Hall, Port Orchard,
Washington, at 8:00 o'clock p.m. (PDST) on October 14, 1968,
which time and place are hereby fixed for hearing all matters

relating.to said proposed improvement and all objects thereto.
and for determining the method of payment for said improvement.
Section 5. Hammond, Collier and Isaac, consulting
engineers of the City, are hereby directed to submit to the
City Council on or prior to the 14th day of October, 1968, all
data and information required by law to be submitted.
The foregoing Resolution was adopted by the unanimous
vote of the City Council of the City of Port Orchard, Washington,
and approved by the Mayor at a regular meeting thereof on this
9th day of September, 1968.
