A RESOLUTION OF THE CITY OF PORT ORCHARD,
ESTABLISHING THE POLICIES THAT WILL BE FOLLOWED
BY THE CITY OF PORT ORCHARD IN THE COURSE OF
ACQUISITION OF SUCH REAL. PROPERTY AS MAY BE
NECESSARY FOR THE IMPROVEMENT OF THAT AREA
KNOWN AS WEST PORT ORCHARD BY THE INS T A I-LATION
OF A SYSTEM OF SANITARY SEWER, FOR WHICH
FEDERAL ASSISTANCE HAS BEEN REQUESTED.
WHEREAS, the City of Port Orchard is asking Federal Assistance
for the installation of a system of sanitary sewers in that area commonly
known as West Port Orchard, and it is necessary to establish a policy
of acquisition of real estate by eminent domain which will be followed;
Now, Therefore,
BE IT AND IT HEREBY IS RESOLVED by the City Council of the
City of Port Orchard as follows:
1. The procedure hereinafter set forth shall be followed by the
City of Port Orchard in the acquisition of all real property that it will be
necessary to acquire by eminent domain for the installation of sanitary
sewers in West Port Orchard;
2. The City shall make every reasonable effort to acquire the
real property by negotiated purchase;
3. No owner shall be required to surrender possession of
real property before the City pays to the owner (A) the agreed purchase
price arrived at by negotiation, or (B) in any case where only the amount
of the payment to the owner is in dispute, not less than 5 per centum of the
appraised fair value of such property as approved by the City; and
4. The construction or development of any public improvements
shall be so scheduled that no person lawfully occupying the real property
shall be required to surrender possession on account of such construction
or development without at least 90 days' written notice from the City of the
date on which such construction or development is scheduled to begin.
