1002 - Resolution - Animal EnforcementAREAS, the City of Port Orchard has passed and will pass certain ordinances pertaining to the control, care and treatment of animals; and WHEREAS, the.Kitsap County Humane Society is equipped to carry out the program instituted by the City of Port Ordhard. ; and WHEREAS, the City of Port Orchard intends to partly fi- nance the work and operations of the Kitsap County Humane Society for the execution of the City's program; NOW, THEREFORE., BE IT RESOLVED BY THE COUNCIL, OF THE CITY OF PORT ORCHARD: That the proper officers of the City of Port Orchard be and are hereby authorized to execute and deliver a contract for the enforcement of ordinances of the City of Port Orchard, pertaining to animals substantially upon the terms and condi- tions of the Agreement attached hereto, which Agreement is incorporated herein and made a part of this resolution by this reference thereto. - Adoyted o , roll call 1961 Ayes e Nays Absent Attest ity C er V,. f Mayor AGREEMENT THIS AGBENT, made and entered into by and between the City of Port orchard, Washington, a municipal corporation., hereinafter referred to as the "City", and the Kitsap County Humane Society, a nonprofit corporation organized and existing under and by virtue of the laws of the State of Washington, hereinafter referred to as the "Society", WITNESSETH: . For and in consideration of the mutual promises and agreements hereinafter contained, it is hereby mutually agreed by the parties hereto as follows: 1. TEAT the Society shall provide impound services and facilities for all animals for which impounding is author- ized or ordered by the City of Port Orchard. 2. THAT the Society shall faithfully enforce all ordinances of the City and laws of the State of Washington now in effect or that hereafter may be enacted relative to the impounding of -animals; the care and treatment of animals; dangerous animals; or animals creating nuisances. 3. THAT,the Society shall faithfully carry out and enforce all lawful orders of the Health Officer of the Bremer- ton-Kitsap*County Health Department pertaining to animals and the quarantine of animals. 4. THAT the Society agrees to commence its opera- tion on the first day of September, 1961. 5. THAT the Society, during the term of this con- tract, shall function as a nonprofit society. 6. THAT the Society shall not, during the life of this agreement, train or board animals for pay, nor shall it engage in the business of selling animals, medicine, food or supplies for animals, nor in the business of furnishing vet- erinary or grooming services for pay; provided that nothing herein contained shall be construed to prevent the Society from selling impounded animals, estrays or gift animals, nor the selling of adequate leash equipment for dogs redeemed or sold from the premises. The Society shall not permit any of its employees to conduct any of such activities upon any prem- ises owned or controlled by it. 7• THAT the City agrees to pay to the Society for the services performed by the Society all funds received from the impounding and sale of animals. 8. THAT the City further agrees to advance, as its proportionate share of the county -pride animal control program, the following sums: a. On the 15th day of August, 1961, the sum of $231.00, which represents the City's share of the initial out- lay and the first month's operating expenses. b. On the first day of October, and on the first day of each succeeding month during the calendar year 1961, the sun of $99.00. 9. THAT this agreement shall be effective as of August 15, 1961, and shall be in force and effect -until Decem- ber 31, 1961, and may be extended from year to year by mutual agreement of the parties, confirmed on the part of the City by resolution of.the City Council.
