CITY OF PORT ORCHARD PROFESSIONAL SERVICES AGREEMENT WITH
RH2 ENGINEERING, INC.
THIS AMENDMENT No. 2 to Contract No. 054-18 ("Amendment No. 2") is made effective as of
the I & day of December, 2019, by and between the City of Port Orchard ("City), a municipal corporation,
organized under the laws of the State of Washington, and RH2 Engineering, Inc., a company organized under
the laws of the State of Washington, located and doing business at 22722 29' Drive SE, Suite 210, Bothell,
WA 98021 ("Consultant").
WHEREAS, on July 24, 2018, the City executed a Professional Services Agreement with Consultant,
for the provision of engineering consultation services related to the 2018-2019 Marina Pump Station Rebuild
Project ("Underlying Agreement'); and
WHEREAS, the Underlying Agreement's expiration date was July 31, 2019; and
WHEREAS, Amendment No. 1 to the Underlying Agreement, dated July 22, 2019, extended the
expiration date to December 31, 2019; and
WHEREAS, Section 3 of the Underlying Agreement provides for the amendment thereof by a written
instrument properly signed by both parties; and
WHEREAS, the parties have agreed that it is in the interests of both to extend the Underlying
Agreement until March 31, 2020; and
WHEREAS, the parties wish to memorialize their agreement to so further extend the Underlying
Agreement; NOW, THEREFORE,
In consideration of the mutual benefits accruing, it is agreed by and between the parties thereto as
follows:
1. The Underlying Agreement of July 24, 2018 between the parties, as amended by Amendment
No. 1, is further amended in, but only in, the following respect:
The termination date set forth in Section 3 of the Underlying Agreement is hereby amended to March
31, 2020.
2. In all other respects, the Underlying Agreement between the parties shall remain in full force
and effect, amended as set forth herein, but only as set forth herein.
IN WITNESS WHEREOF, the parties have executed this Amendment No. 2 on the day and
year set forth above.
