033-15 - LaCross & Murphy, PLLC - Contract Amendment 3Amendment No. 3 to Contract No. 033-15 CITY OF PORT ORCHARD AGREEMENT FOR ATTORNEY SERVICES THIS AMENDMENT to Contract No. 033-15 ("Amendment") is made effective as of the 25" of April, 2017, by and between the City of Port Orchard ("City"), a municipal corporation, organized under the laws of the State of Washington, and LaCross & Murphy, PLLC, a professional limited liability company organized under the laws of the State of Washington, located and doing business at 559 Bay Street, Port Orchard, WA 98366 ("Public Defender"). WHEREAS, the parties have entered into an underlying agreement for Attorney Services, designating the Public Defender as the City's provider of public defender legal services, effective January 1, 2015 (the "Underlying Agreement"), which has been amended on two previous occasions; and WHEREAS, the parties are desirous of amending the Underlying Agreement to reflect a change in the primary attorney assigned to perform the services provided by the Underlying Agreement: NOW. THEREFORE, In consideration of the mutual benefits accruing, it is agreed by and between the parties thereto as follows: 1. The Underlying Agreement between the parties, effective January 1, 2015, as amended by Amendment Nos. 1 and 2 to Contract No. 033-15, all three documents incorporated by this reference as fully as if herein set forth, is amended in, but only in, the following respect: 1.1. Amendment to Exhibit A, Scope of Sen ice. The second paragraph under the Scope of Service section of Exhibit A to the Underlying Agreement shall be amended to read as follows: The Public Defender will designate Daniel Peet (WSBA 43787) to be the primary attorney assigned to perform these services. Should the designated attorney be unavailable or exceed caseload limitations, the following attorneys will assist the designated primary attorney: David LaCross (WSBA 31417) and Jacob Murphy (WSBA 29818). Should the firm hire additional legal counsel, said counsel shall not be authorized to appear on behalf of the Public Defender absent prior written consent of the City. 2. In all other respects, the Underlying Agreement between the parties, as amended by Amendment Nos. 1 and 2 to Contract No. 033-15, shall remain in full force and effect, amended as set forth herein, but only as set forth herein.
