ORDINANCE NO. 017-22
AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON,
ACCEPTING THE STATE OF WASHINGTON TRANSPORTATION
IMPROVEMENT BOARD GRANT AGREEMENT TERMS AND CONDITIONS
FOR THE POTTERY ROAD NON-MOTORZIED IMPROVEMENT PROJECT
AND AUTHORIZING THE MAYOR TO EXECUTE THE CONTRACT;
PROVIDING FOR SEVERABILITY AND PUBLICATION; AND SETTING AN
EFFECTIVE DATE.
WHEREAS, on March 251", the Washington State Transportation Improvement Board
(TIB) selected the City of Port Orchard for a Complete Streets Award; and
WHEREAS, on April 20, 2022, the City of Port Orchard Public Works Department was
notified that the City's proposed workplan was accepted for improvements to Pottery Road,
and that the award amount would be $650,000; and
WHEREAS, the TIB provided the City with a grant agreement for the award; and
WHEREAS, the Port Orchard City Council has determined it to be in the best interest of
the City to accept the grant award and enter into the agreement with the State of Washington
TIB; now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN AS
FOLLOWS:
SECTION 1. The City Council accepts the TIB Complete Streets Award and authorizes the
Mayor's to execute a contract with the (TIB Agreement C-W-153(110)-1) with the State of
Washington for the Pottery Non -motorized Improvement Project and any other associated
documentation necessary to effectuate the award.
SECTION 2. Severability. If any section, sentence, clause or phrase of this Ordinance
should be held to be unconstitutional or unlawful by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or constitutionality of any other
section, sentence, clause or phrase of this Ordinance.
SECTION 3. Publication. This Ordinance shall be published by an approved summary
consisting of the title.
SECTION 4. Effective Date. This Ordinance shall take effect and be in full force and
effect five days after publication, as provided by law.
