038-20 - Kitsap Transit - ContractPERMISSION TO ENTER The undersigned Owner of the following described Property hereby grants Kitsap Transit access to the Property in connection with the Port Orchard Park & Ride Project. Owner is willing to grant Kitsap Transit access to the Property on the terms and conditions of this Agreement. The Property is described as follows: Parcel Intersection: Parcel Numbers: 1. Grant of License. 342401-3-035-2000 Owner grants to Kitsap Transit a non-exclusive license of reasonable access to the Property for the purpose of exploration and collecting site information in connection with the Port Orchard Park & Ride Project. Kitsap Transit will not permit any other party, except Kitsap Transit duly authorized representatives, employees, agents, and independent contractors (collectively "Representatives") to enter or use the Property. 2. Contacts. Prior to access, Kitsap Transit and/or its designated Representatives shall contact the following representatives of the owner to arrange for access and to obtain information regarding the Property: Property Access: Name: Telephone Other: 3. Liability. While on the Property, Kitsap Transit will comply and will cause all Representatives to comply with all applicable government laws and regulations. Kitsap Transit and its Representatives will be responsible for any damage done to the Property by Kitsap Transit or its Representatives and will pay the cost of repairing and restoring the Property to as good condition as existed before Kitsap Transit or its Representative's entry onto the Property. 4. Governing Law/Captions. The validity, meaning, and effect of this Agreement shall be determined in accordance with the laws of the State of Washington. 5. No Third Party Rights/Assignment. Nothing in this Agreement, express or implied, is intended to confer any rights or remedies upon any person, other than the parties and their respective employees and representatives. 6.
