A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, AUTHORIZING
THE MAYOR TO EXECUTE A CONTRACT WITH RICE, FERGUS, MILLER, INC. FOR
CONSTRUCTION SUPPORT SERVICES FOR THE CITY HALL RENOVATION PROJECT
AND WAIVING CITY PROCUREMENT PROCEDURES.
WHEREAS, the City routinely inspects and assesses the condition of its facilities and in
the course of its inspections of the City Hall facility, staff determined the need for a City Hall
Renovations Project; and
WHEREAS, on October 13, 2020, following a competitive selection process consistent
with RCW Chapter 39.80, City entered into a Professional Services Architecture and Engineering
Agreement with Rice, Fergus, Miller, Inc. (RFM), to determine the current and future needs of
the building and to prepare a design for the needed building renovations; and
WHEREAS, the design is now complete, and the project is beginning its construction
phase; and
WHEREAS, the City Public Works Department determined that expert construction
management services are required for this project during the construction phase; and
WHEREAS, due to limited staff resources the City desires the assistance of a consultant
with the expertise and qualifications to provide these services; and
WHEREAS, RFM has in-depth expertise and knowledge regarding the design and
familiarity with the construction plans, and is a qualified consultant to provide construction
management services for this project; and
WHEREAS, on June 16, 2023, RFM provided a defined Scope of Work and Budget for the
City Hall Construction Management Services; and
WHEREAS, on June 16, 2023, Staff verified that RFM met the responsibility criteria and
is not disqualified from working on this project; now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES
AS FOLLOWS:
THAT: It is the intent of the Port Orchard City Council that the recitals set forth above
are hereby adopted and incorporated as findings in support of this Resolution.
THAT: The City Council authorizes a limited waiver of the procurement procedures set
out in the City's Procurement Policies pertaining to this professional service (non -
Architectural and Engineering service) and authorizes the Mayor to execute a Contract
with Rice, Fergus, Miller, Inc. for City Hall Construction Management Services.

THAT: The Resolution shall take full force and effect upon passage and signatures
hereon.
PASSED by the City Council of the City of Port Orchard, SIGNED by the Mayor and attested
by the Clerk in authentication of such passage this 27th day of June 2023.
