069-23 - Resolution - Contract with Aqua Tech for McCormick Woods STEP SystemDocuSign Envelope ID: 4D6FEF55-E997-4328-A022-8A4EF4D14C08 RESOLUTION NO.069-23 A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, APPROVING A CONTRACT WITH AQUA TECH, LLC FOR MCCORMICK WOODS STEP SYSTEM RETROFIT PROJECT AND DOCUMENTING THE SMALL PUBLIC WORKS ROSTER PROCUREMENT PROCEDURES. WHEREAS, the City annually offers the McCormick Woods Step System Retrofit Program for residents in the McCormick Woods Community who have Septic Tank Effluent Pumping (STEP) systems to convert/upgrade residential STEP systems to grinder pumps; and WHEREAS, the City desires to contract for the McCormick Woods STEP System Retrofit Project; and WHEREAS, as performed annually since 2013, the Municipal Research and Services Center of Washington (MRSC) solicited on behalf of participating local government agencies within Washington State (including the City of Port Orchard) for the 2023 MRSC Small Public Works Roster; and WHEREAS, on May 10, 2023, pursuant to RCW 39.04.155 and the City's Procurement Policies (adopted by Resolution No. 036-22, as amended), the City's Public Works Department established a roster of qualified contractors from the MRSC 2023 Small Works Roster for the Main Category — Septic System and Sub -Category — Septic Tank Cleaning/Pumping, Septic Tank Installation; and WHEREAS, on May 10, 2023, and pursuant to the City's Procurement Procedures adopted as Resolution No. 036-22, as amended, at Section 5.0 Bid Procedures, the City's Public Works Department issued an email Request for Proposal (RFP) for the Project to all the contractors from the selected Roster; and WHEREAS, by the 2:00 pm, June 9, 2023, due date the City received one (1) proposal from Aqua Tech, LLC of $143,657.42 (applicable tax included); and WHEREAS, on June 12, 2023, the City's Public Works Department completed the MRSC Mandatory Bidder Responsibility Checklist on Aqua Tech, LLC; and WHEREAS, after reviewing the proposal and verifying the contractor's information, Public Works Staff determined Aqua Tech, LLC met the requirements and criteria as described in the RFP and was the lowest responsive and qualified bidder for the project; and WHEREAS, the Port Orchard City Council, at the 2015 recommendation of the State Auditor's Office, wishes to document their consultant selection process as described above for this particular contract by Resolution; now, therefore, DocuSign Envelope ID: 4D6FEF55-E997-4328-A022-8A4EF4D14C08 Resolution No. 069-23 Page 2of2 THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: THAT: It is the intent of the Port Orchard City Council that the recitals set forth above are hereby adopted and incorporated as findings in support of this Resolution. THAT: The City Council approves and authorizes the Mayor to execute a Contract with Aqua Tech, LLC for the McCormick Woods STEP System Retrofit Project. THAT: The Resolution shall take full force and effect upon passage and signatures hereon.
