09/08/2015 - MinutesUtility Committee Minutes Meeting of September 8, 2015 Page 1 of 1 City of Port Orchard Utility Committee Meeting Minutes September 8, 2015 Utility Committee Members Rob Putaansuu, John Clauson and Cindy Lucarelli met on September 8, 2015 at 5:30 p.m. at the Port Orchard City Hall – Council Conference Room. Also present: Public Works Director Mark Dorsey, Storm Water Manager Andrea Archer-Parsons, City Attorney Carol Morris and Citizens; Nick Whittleton, Dick Brown, Mike Eliason, Teresa Osinski, Mr. & Mrs. Billy Goodwin, Gary Anderson, Tom O’Brien, Ken Morrison, Bruce Yoder and Norm Olson. Public Market Water and Sewer Rates – Discussion Cont’d.: As requested by the Utility Committee on July 16, 2015, and in continued response to the email from Don Ryan (dated May 12, 2015) regarding water and sanitary sewer rates billed for the Public Market, PWD Dorsey worked with Katy Isaksen and Utility Billing to 1) prepare a draft revision to POMC 13.04.020 thereby creating a Public Market Class 21 category and 2) prepare a pros/cons memo for developing a Commercial Volume-Based Sewer Billing. In general summary, the volume-based proposal appears to have several unintended consequences, where the creation of a new Class 21 appears promising. To be discussed by full Council at the September 22, 2015 Work Study Session. Storm Drainage Mitigation Vesting - Discussion: As directed by Council at the August 25, 2015 Regular Meeting and pursuant to the Department of Ecology’s desire to vest storm drainage mitigation at time of permit instead of complete application, PWD Dorsey provided Committee members with a brief summary of current mitigation vesting issues facing the Public Works Department; 1) providing relevant due diligence vesting information for future development and 2) how to handle currently constructed and completed regional stormwater mitigation facilities that have previously approved upland development remaining, but the stormwater mitigation standards have changed. In general summary and pursuant to City Attorney direction, all new development proposals will require a Development Agreement to address potential stormwater vesting and all existing previously vested and constructed regional facilities will be reviewed on a case-by-case basis upon receipt of a triggering Application.
