002-16 - Ordinance - Land Use and Zoning, to Change Maximum Residential Density in Mixed Use Zone, Amend Sec 16.40.025ORDINANCE NO.002-16 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, RELATING TO LAND USE AND ZONING, TO CHANGE THE MAXIMUM RESIDENTIAL DENSITY PERMITTED IN THE CITY'S MIXED USE ZONE; AMENDING PORT ORCHARD MUNICIPAL CODE SECTION 16.40.025 WHEREAS, in August 2014 Department of Community Development found that the Mixed Use (Mxd) zone limits residential density to 12 dwelling units per acre; and WHEREAS, this limit is inconsistent with the Comprehensive Plan's goals and policies related to fostering a lively and vibrant downtown neighborhood, which is the largest area in the City of Port Orchard with a Mixed Use zone; and WHEREAS, existing land use regulations, particularly the Downtown Overlay District, sufficiently control the scale and character of development in downtown, including but not excluding building height, street and yard setbacks, and site coverage; and WHEREAS, the number of dwelling units within a structure is also limited by the requirement, set forth in POMC Section 16.20.208, that newly constructed dwelling units in the Downtown Overlay District must be a minimum size of 600 square feet; and WHEREAS, minimum street and yard setbacks and lot coverage are inconsistent with the existing character of the downtown neighborhood; and WHEREAS, the enactment of this ordinance is unlikely to significantly affect the character of the downtown neighborhood in the short term but may improve it in the long term; and WHEREAS, a draft of this Ordinance was presented to the Planning Commission for review and a public hearing on February 23, 2015; and WHEREAS, on February 23, 2015, the Planning Commission issued a recommendation to approve the amendment to the mixed use zone increasing the density within the zone; and WHEREAS, a SEPA DNS was issued on the proposed amendment on December 25, 2015; and WHEREAS, the Department of Commerce was provided notice of the proposed change on December 17, 2015 along with a request for expedited review; and Ordinance No. 002-16 Page 2 of 9 WHEREAS, a public hearing on this Ordinance was held at a regularly -scheduled City Council meeting on January 12, 2016; now, therefore THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION 1. The City Council adopts all of the "Whereas" sections in this Ordinance as findings in support of this Ordinance. SECTION 2. Section 16.40.025 of the Port Orchard Municipal Code is hereby amended as set forth in the attached Exhibit A. SECTION 3. Severability. If any section, sentence, clause or phrase of this Ordinance should be held to be unconstitutional or unlawful by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this Ordinance. SECTION 4. Publication. This Ordinance shall be published by an approved summary consisting of the title. SECTION S. Effective Date. This Ordinance shall take effect and be in full force and effect five days after publication, as provided by law. ORDINANCE NO.002-16 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, RELATING TO LAND USE AND ZONING, TO CHANGE THE MAXIMUM RESIDENTIAL DENSITY PERMITTED IN THE CITY'S MIXED USE ZONE; AMENDING PORT ORCHARD MUNICIPAL CODE SECTION 16.40.025 Copies of Ordinance No. 002-16 are available for review at the office of the City Clerk of the City of Port Orchard. Upon written request a statement of the full text of the Ordinance will be mailed to any interested person without charge.
