009-16 - Ordinance - Amending Chapter 2.04 Council MeetingsORDINANCE NO.009-16 AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON, AMENDING PORT ORCHARD MUNICIPAL CODE CHAPTER 2.04 ("COUNCIL MEETINGS") SECTIONS 10, 60, 100, 120, AND 210 TO INCORPORATE CERTAIN CURRENT PRACTICES, AND TO ADOPT POLICIES FOR TAKING ACTION MINUTES AND COUNCIL SPONSORING OF ORDINANCES WHEREAS, at the February 20, 2016, Council retreat, Councilmembers discussed changing from taking detailed meeting minutes to taking action only minutes for regular City Council meetings and taking minutes of work study session meetings in the form of a brief summary, unless video recording of the meeting is not available; and WHEREAS, at the February 20, 2016, Council retreat, Councilmembers discussed adopting a policy to have a Councilmember sponsor each ordinance to assure the ordinance would be supported when staff brought it forth at a City Council meeting for consideration; and WHEREAS, at the February 20, 2016, Council retreat, City staff advised the City Council that certain current practices have not been incorporated into the Port Orchard Municipal Code and staff proposed to update the code to reflect these current practices of the Council and staff, and WHEREAS, at the March 15, 2016, Council work study session, City staff was directed to bring forth an ordinance amending POMC 2.04 to reflect the above - referenced discussions at the Council retreat; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION 1. Section 2.04.010 of the Port Orchard Municipal Code is hereby amended to read as follows: 2.04.010 Meeting time and place. A) Regular Business Meetings. The regular meeting of the city council shall be held on the second and fourth Tuesday of every month, in the council chambers of City Hall, commencing at the hour of 7:00 p.m. and continuing to 10:00 p.m. To continue past the 10:00 p.m. adjournment time, a majority of the city council must concur. In the event any regular meeting falls on a holiday, the city council shall meet on the next business day at the same hour. B) Study Sessions. Council study session shall be held on the third Tuesday of every Ordinance No. 009-16 Paee 2 of 4 month, in the council chambers of City Hall, commencing at the hour of 7:00 p.m. In the event the work study session falls on a holiday, the city council shall meet on the next business day at the same hour. SECTION 2. Section 2.04.060 of the Port Orchard Municipal Code is hereby amended to read as follows: 2.04.060 Order of business. The order of business shall be as follows: (1) Call to order and roll call; (A)Pledge of allegiance; (2) Approval of agenda; (3) Citizens comments; (4) Approval of consent agenda; (5) Presentations; (6) Public hearings; (7) Business items; (8) Council committees reports; (9) Mayor's report; (10) Department directors' reports; (11) Citizens comments; (12) Executive session; (A) Motions as a result of executive session; (13) Adjournment; (14) Committee meetings, date, time, and location. SECTION 3. Section 2.04.100 of the Port Orchard Municipal Code is hereby amended to read as follows: 2.04.100 Motions in writing. Motions shall be reduced to writing when required by the presiding officer of the council or any member of the council. All resolutions and ordinances shall be in writing. Ordinances shall have a sponsoring councilmember. SECTION 4. Section 2.04.120 of the Port Orchard Municipal Code is hereby amended to read as follows: 2.04.120 Journal kept by clerk. The clerk shall keep a correct journal of all proceedings and at the desire of any member the ayes and nays shall be taken on any question and entered in the journal. The journal shall reflect action taken only when at regular meetings. Work study sessions shall reflect a brief summary. SECTION 5. Section 2.04.210 of the Port Orchard Municipal Code is hereby amended to read as follows: Ordinance No. 009-16 Paee 3 of 4 2.04.210 City employees requested to attend. The chair shall assure that all regular meetings, workshops, special and emergency meetings of the council are appropriately staffed. While the authority for requiring department heads to attend council meetings rests with the mayor, the council is free to refuse to take action on particular agenda items where necessary department directors are not present. SECTION 6. Section 2.04.220 of the Port Orchard Municipal Code is hereby amended to read as follows: 2.04.220 Duty of presiding officer. It shall be the duty of the presiding officer of the regular council meeting to: (1) Call the meeting to order; (2) Keep the meeting to its order of business; (3) State each motion and require a second to that motion before permitting discussion; (4) Handle discussion in an orderly way: (a) Give every councilmember who wishes an opportunity to speak; (b) Permit audience participation at appropriate times; (c) Keep all speakers to the rules and to the questions; (d) Give pro and con speakers alternating opportunities to speak; (5) Put motions to a vote and announce the outcome; (6) Suggest but not make motions for adjournment. Section 7. Severability. If any section, sentence, clause or phrase of this Ordinance should be held to be unconstitutional or unlawful by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this Ordinance. Section 8. Publication. This Ordinance shall be published by an approved summary consisting of the title. Section 9. Effective Date. This Ordinance shall take effect and be in full force and effect five days after publication, as provided by law.
