AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PORT ORCHARD,
WASHINGTON, RELATING TO THE COMPREHENSIVE PLAN UNDER THE GROWTH
MANAGEMENT ACT; ADOPTING AN AMENDMENT TO APPENDIX G OF THE
COMPREHENSIVE PLAN REPLACING THE 2014 6-YEAR TRANSPORTATION
IMPROVEMENT PROGRAM WITH AN UPDATED 2016-2035 TRANSPORTATION
IMPROVEMENT PROGRAM, AND SETTING AN EFFECTIVE DATE.
WHEREAS, the City of Port Orchard plans under the Growth Management Act (chapter
36.70A RCW), which requires that the City adopt a Comprehensive Plan (RCW 36.70A.040); and
WHEREAS, the City may annually adopt amendments to the City's Comprehensive Plan
(RCW 36.70A.470 and 36.70A.106); and
WHEREAS, the City's deadline for submission of applications for amendments to the
Comprehensive Plan for the year 2015 was June 15, 2015; and
WHEREAS, the City received 1 application for an amendment to the Comprehensive Plan
before the deadline; and
WHEREAS, the SEPA Responsible Official performed SEPA on the proposal and issued a
Determination of Nonsignificance (DNS) on April 3, 2015; and
WHEREAS, on September 21, 2015 the Planning Commission held a public hearing on
the application and after hearing public testimony, deliberated and issued their
recommendation to approve the proposed amendment; and
WHEREAS, the Planning Commission's recommendation was delivered to the City
Council, and the City Council considered the recommendation during a public hearing held by
the City Council on November 10, 2015; NOW THEREFORE
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, ORDAINS AS
FOLLOWS:
Section 1. The City Council considered the comprehensive plan amendment
application and the Planning Commission's recommendation on the proposed amendment to
Ordinance No. 021-15

Appendix G of the Comprehensive Plan updating the city's Transportation Improvement
Program described as follows:
Amendment to Appendix G — 2016-2035 Transportation Improvement Program.
1. Description. The Proposed Amendment would add the 2016-2035
Transportation Improvement Program to Appendix G, "Plans Adopted by Reference"
and replace the existing reference to the 2014 6-Year Transportation Improvement
Program.
2. Findings. In 2014, the City Council approved Ordinance 016-14 amending
the Comprehensive Plan including the adoption of the 2014 6-year transportation
improvement program by reference in appendix G of the Comprehensive Plan. The city
is required to adopt a new 6-year transportation improvement program annually under
RCW 35.77.010. The City Council passed Resolution 014-15 on June 23, 2015 adopting
the 2016 Transportation Improvement Program. This Resolution adopted an update to
the 6-year Transportation Plan that is currently adopted by reference in Appendix G of
the Comprehensive Plan. This proposed comprehensive plan amendment will have the
effect of incorporating the changes made to the 6-year Transportation Improvement
Program under Resolution 014-15 into the Comprehensive Plan and will add a second
tier to the Transportation Improvement Program covering the years 2022-2035. The
Planning Commission after a public hearing at its September 21, 2015 meeting
recommended approval of the proposed amendment.
3. Staff Recommendation: City staff has recommended approval of the
proposed Transportation Plan Amendment.
4. Planning Commission Recommendation: On September 21, 2015, the
Planning Commission conducted a public hearing on the proposed amendment and
after taking public testimony, deliberated and issued their recommendation of approval.
5. Council Conclusions — Text Amendments
The City Council concludes that it is appropriate to adopt the 2016-2035 Transportation
Improvement Program by reference into Appendix G of the Comprehensive Plan
replacing the 2014 6-Year Transportation Improvement Program.
Section 2. Amendments Approved. The 2015 application to amend Appendix G of the
Port Orchard Comprehensive Plan to update the Transportation Improvement Program
adopting the 2016-2035 Transportation Improvement Program is hereby approved.
Section 3. Publication. This Ordinance shall be published by an approved summary
consisting of the title.

Section 4. Severability. If any section, sentence, clause or phrase of this Ordinance
should be held to be unconstitutional by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or constitutionality of any other section,
sentence, clause or phrase of this Ordinance.
Section 5. Effective Date. This Ordinance shall become effective five days after
publication as provided by law.
