A RESOLUTION OF THE ClW OF PORT ORCHARD, WASH NGTON, APPROVING
CONTRACT NO. C067.19 WITH STELIAR J CORPORATION FOR THE MCCORMICK
SEWERAGE L FT STAT ON NO. 2 PROJECT AND DOCUMENTING THE
PROCUREMENT PROCEDURES
WHEREAS, on October 4, 2OL9 and October LL, 2OL9, the City's Public Works
Department Advertised in the Port Orchard lndependent, the City's Webpage, the Daily Journal
of Commerce and uploaded the Bid Documents to the Washington Builder's Exchange, with an
October 25,2OL9 Bid Due Date; and
WHEREAS, between October 2L,2Ot9 and November 5,2OL9, five (5) Addendum were
published, with the revised Date of Bid Opening extended to November 8, 2019; and
WHEREAS, by the November 8, 2Ot9, by the 2:00 PM Bid deadline, the City Clerk
received and opened eleven (11) Sealed Bids, with Stellar J Corporation determined initially to
be the apparent responsive Low Bid; and
WHEREAS, later November 8, 2OL9, the City of Port Orchard Public Works Staff notified
Stellar J Corporation that their Bid appeared to be 'non-responsive' and that the Project Award
would be delayed until further review by City Staff could be completed; and
WHEREAS, on November LL, 2OL9, the City received a Bid Protest from Stellar J
Corporation, which was then reviewed by both the City's Public Works Department Staff and
the City Attorney; and
WHEREAS, upon review of the Bid Protest material and the relevant law, it was
determined that it is appropriate to award the Project to Stellar J Corporation, so upon the
completion of the Bid Tabulation and Bidder Responsibility Checklist, it was determined that
Stellar J Corporation provided the lowest responsive and qualified Bid Proposal for the
McCormick Sewerage Lift Station No. 2 Project; and
WHEREAS, the Port Orchard City Council, at the 2015 recommendation of the State
Auditor's Office, wishes to document their selection/procurement process as described above
for this particular contract by Resolution; now, therefore,
THE CITY COUNC t OF THE C TY OF PORT ORCHARD, WASH NGTON, HEREBY RESOLVES
AS FOLTOWS:
THAT: The City Council approves Contract No. O67-L9 with Stellar J Corporation for the
McCormick Sewerage Lift Station No. 2 Project and adopts the "Whereas" statements
contained herein, as findings in support of the City's selection and procurement procedures.
