A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON AUTHORIZING
A CORRECTION TO A UTILITY BILLING ACCOUNT FOR 314 TRACY AVE. N AND
ADOPTING FINDINGS IN SUPPORT OF THE CORRECTION.
WHEREAS, the property located at 314 Tracy Ave. N is currently being used as a duplex,
but is billed in the city's utility billing system as a single-family residence; and
WHEREAS, from 1979 until at least 1982, the structure at this address was billed as a
duplex in the city's utility billing system; and
WHEREAS, the city does not possess utility records for the property from 1982 until
1999;and
WHEREAS, the property sold on May 20, 2010 to a new owner who understood the
property to be a legal duplex; and
WHEREAS, a duplex is an allowed use at this address; and
WHEREAS, neither the city nor the new owner have records concerning reasons for the
change in the utility account that occurred sometime between 1982 and 1999; and
WHEREAS, the new owner wishes to continue to use the property as a duplex; and
WHEREAS, the city needs to correctly bill the structure as a duplex; and
WHEREAS, staff lacks the authority to change the billing classification for this structure
in the absence of payment of capital facility charges and or payment of previous billings which
incorrectly assumed that the structure was used as a single-family residence; now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES
AS FOLLOWS:
THAT: The City Council authorizes city staff to correct the utility billing account
information for the structure at 314 Tracy Ave. N to reflect its use as a duplex effective
July 1, 2017. This correction shall not apply retroactively or require the payment of
capital facilities charges for water or sewer. This correction in no way makes a
determination concerning whether the structure at 314 Tracy Ave. N was legally
established.
