053-17 - Resolution - Fixing the Date of a PH on a Petition to Vacate a Portion of City ROW Located at Bay StreetRESOLUTION NO. 053-17 A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, FIXING THE DATE OF PUBLIC HEARING ON A PETITION TO VACATE A PORTION OF CITY RIGHT-OF-WAY LOCATED AT BAY STREET. WHEREAS, the petitioners, Ann Schnitzer with Marlee Apartments, LLC, have submitted a petition to vacate a portion of City right-of-way located at Bay Street; and WHEREAS, the petitioners constitute the owners of more than two-thirds (2/3) of the property abutting the area proposed for vacation pursuant to RCW 35.79.010; and WHEREAS, the property sought to be vacated is approximately 407 square feet; and WHEREAS, the legal description of the property sought to be vacated is as follows:! i LOT 14, BLOCK 15, FIRST ADDITION TO SIDNEY AS PER PLAT RECORDED IN VOLUME 1 OF PLATS, PAGE 10, RECORDS OF KITSAP COUNTY, WASHINGTON; SITUATE WITHIN GOVERNMENT LOTS 1, 2, 3 AND 4, SECTION 25 AND WITHIN GOVERNMENT LOTS 3 AND 4, SECTION 26, TOWNSHIP 24 NORTH, RANGE 1 EAST, W.M., CITY OF PORT ORCHARD, KITSAP COUNTY, WASHINGTON DESCRIBED AS FOLLOWS: COMMENCING AT THE NORTHWEST CORNER OF THE RIGHT OF WAY INTERSECTION OF BAY STREET AND ROCKWELL AVENUE, BEING THE SOUTHEAST CORNER OF PARCEL NUMBER °4053-015-012-0002 PER KITSAP COUNTY ASSESSOR'S OFFICE; THENCE NORTH 88 21'15" WEST, 29.22 FEET ALONG THE NORTH RIGHT OF WAY LINE OF BAY STREET TO THE TRUE POINT OF BEGINNING; THENCE SOUTH 00 O08'24" EAST, 12.87 FEET; THENCE SOUTH 89 42'23" WEST, 30.36 FEET; THENCE NORTH 00 09'12" WEST, 13.90 FEET TO THE NORTH RIGHT OF WAY LINE OF SAID BAY STREET, THENCE SOUTH 88 21'15n EAST, 30.38 FEET ALONG SAID NORTH RIGHT OF WAY LINE TO THE TRUE POINT OF BEGINNING. WHEREAS, petitioners have requested that proceedings be had hereon for the vacation of said portion of the city right-of-way in the manner prescribed by RCW 35.79; and WHEREAS, the street vacation is needed to receive WSDOT certification of right-of-way for the Bay Street Pedestrian Pathway and staff recommends moving the petition forward to the full City Council to conduct a public hearing; now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: Resolution No. 053-17 Page 2 of 2 THAT: A Public Hearing upon said proposed street vacation shall be held in the Robert G. Geiger Council Chambers at City Hall located at 216 Prospect Street, Port Orchard, Washington on Tuesday, October 24, 2017 at 6:30 p.m., at which hearing all persons interested in said street vacation are invited to appear. THAT: The City Clerk is directed to post notice of the petition in three of the most public places in the city and a like notice in a conspicuous place on the street sought to be vacated, pursuant to RCW 35.79.020. The Clerk shall also post the notice on the City's website.
