054-17 - Resolution - Fixing the Date of a PH to Vacate Portion of City ROW Located at Rockwell AvenueRESOLUTION NO. 054-17 A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, FIXING THE DATE OF PUBLIC HEARING ON A PETITION TO VACATE A PORTION OF CITY RIGHT-OF-WAY LOCATED AT ROCKWELL AVENUE. WHEREAS, the petitioner, City of Port Orchard City Council, proposes to vacate a portion of City right-of-way located at Rockwell Avenue; and WHEREAS, the Council has made a preliminary determination that this portion of the street is not needed for public travel now or in the foreseeable future; and WHEREAS, the property sought to be vacated is approximately 1,176 square feet; and WHEREAS, the legal description of the property sought to be vacated is as follows: SITUATE WITHIN GOVERNMENT LOTS 1, 2, 3 AND 4, SECTION 25 AND WITHIN GOVERNMENT LOTS 3 AND 4, SECTION 26, TOWNSHIP 24 NORTH, RANGE 1 EAST, W.M., CITY OF PORT ORCHARD, KITSAP COUNTY, WASHINGTON DESCRIBED AS FOLLOWS: COMMENCIGN AT THE SOUTHWEST CORNER OF LOT 12, BLOCK 15, FIRST ADDITION TO SIDNEY AS PER PLAT RECORDED IN VOLUME 1 OF PLATS, PAGE 10 OF KITSAP COUNTY, WASHINGTON; THENCE NORTH 01°30'48" EAST, 119.64 FEET ALONG THE EAST RIGHT OF WAY LING OF ROCKWELL AVENUE TO THE TRUE POINT OF BEGINNING; THENCE NORTH 88°17'05" WEST, 18.98 FEET TO THE WEST RIGHT OF WAY LINE OF SAID ROCKWELL AVENUE; THENCE ALONG SAID WEST RIGHT OF WAY LINE NORTH 01°42'55" EAST, 84.15 FEET; THENCE SOUTH 08°40'13" EAST, 22.33 FEET, THENCE SOUTH 34°18'43" EAST, 4.85 FEET, THENCE NORTH 83°25'11" EAST, 12.01 FEET, TO THE NORTHEAST CORNER OF THIS EASEMENT DESCRIPTION, BEING ALSO ON THE ORDINARY HIGH WATER LINE, THENCE SOUTH 01°30'48" WEST, 60.00 FEET TO THE TRUE POINT OF BEGINNING. WHEREAS, the Council requests that proceedings be had hereon for the vacation of said portion of the right-of-way in the manner prescribed by Chapter 35.79 RCW; and WHEREAS, the City Engineer, Community Development Director, and City Attorney have reviewed the request to vacate and recommend moving the petition forward to the full City Council to conduct a public hearing; now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: Resolution No. 054-17 Page 2 of 2 THAT: A public hearing upon said proposed street vacation shall be held in the Robert G. Geiger Council Chambers at City Hall located at 216 Prospect Street, Port Orchard, Washington on Tuesday, October 24, 2017 at 6:30 p.m., at which hearing all persons interested in said street vacation are invited to appear. THAT: The City Clerk is directed to post notice of the petition in three of the most public places in the city and a like notice in a conspicuous place on the street sought to be vacated, pursuant to RCW 35.79.020. The Clerk shall also post the notice on the City's website and mail notices to all owners of any property abutting the portion of the street proposed to be vacated.
