A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, AUTHORIZING
THE MAYOR TO EXECUTE CONTRACT NO C022-17 WITH N.L. OLSON &
ASSOCIATES, INC. FOR THE BAY STREET PEDESTRIAN PATHWAY SEGMENT #3
2017 ENGINEERING SUPPORT.
WHEREAS, on August 21, 2009, the City of Port Orchard Public Works Department
issued the Request for Qualifications (RFQ) for the design and environmental permitting of the
Bay Street Pedestrian Pathway Project; and
WHEREAS, on September 17, 2009, the City's Public Works Department held interviews
with three (3) qualified consulting firms, scored and ranked the three firms, and based upon the
qualifications received and the interview process, selected N.L. Olson & Associates, Inc. for the
Project; and
WHEREAS, on September 21, 2009 the City's Public Works Department obtained
approval from the Washington State Department of Transportation (WSDOT) Highway's and
Local Program's Office to proceed with a Local Agency Standard Consultant Agreement
(Contract No C071-09} for the design and environmental permitting phase of the Project with
N.L. Olson & Associates; and
WHEREAS, on October 27, 2009, the Port Orchard City Council authorized the Mayor to
execute Contract No C071-09 with N.L. Olson & Associates, Inc.; and
WHEREAS, on December 31, 2015, after the approval and execution of seven (7)
Supplemental Agreements and the completion of the Work, Contract No C071-09 expired; and
WHEREAS, on July 11, 2016, and in accordance with WSDOT LAG Manual Chapter 31.73
for the Segment #3 only Ad Ready PS&E and Environmental Permitting, the WSDOT Highway's
and Local Program's Office approved the Request for Sole Source Consultant Services based
upon the justification that competitive procurement was not appropriate for this Project at this
juncture; and
WHEREAS, having been recently awarded $500,000 by the State of Washington for the
completion of the Segment #3 only Construction Phase, N.L. Olson and Associates, Inc. provided
the City with a professional services fee proposal for the Segment #3 only Ad Ready PS&E and
Environmental Permitting; and
WHEREAS, on January 10, 2017, and in accordance with WSDOT LAG Manual Chapter
31.73 for the Segment #3 Engineering Support for the 2017 Construction Phase, the WSDOT
Highway's and Local Program's Office approved the Request for Sole Source Consultant Services
based upon the justification that competitive procurement was not appropriate for this Project at
this juncture; and

WHEREAS, on February 27, 2017, N.L. Olson and Associates, Inc. provided the City with a
professional services fee proposal for the 2017 Segment #3 Engineering Support; and
WHEREAS, the Port Orchard City Council, at the 2015 recommendation of the State
Auditor's Office, wishes to document their consultant select ion process as described above for
this particular contract by Resolution; now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES
AS FOLLOWS:
THAT: The Port Orchard City Council approves Contract 022-17 with N.L. Olson &
Associates, Inc. for the Segment #3 Bay Street Pedestrian Pathway Project
Engineering Support and adopts the "Whereas" statements contained herein, as
findings in support of the City's consultant selection procurement procedures.
PASSED by the City Council of the City of Port Orchard, SIGNED by the Mayor and attested
by the Clerk in authentication of such passage this 14th day of March, 2017 .
