A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, DECLARING THE
INTENTION OF THE CITY COUNCIL TO ADOPT FOR THE CITY OF PORT ORCHARD
THE CLASSIFICATION OF NON -CHARTER CODE CITY, TO BE GOVERNED BY THE
PROVISIONS OF TITLE 35A OF THE REVISED CODE OF WASHINGTON
WHEREAS, a majority of the City Council of the City of Port Orchard has determined that it
would serve the best interests and general welfare of the City to change the classification of the City
to that of Non -charter code city pursuant to the provisions of RCW 35A.02.030; now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES AS
FOLLOWS:
Section 1. That the City Council does hereby declare its intention to adopt for the City of Port
Orchard the classification of "Non -charter code city."
Section 2. That it is the intention of the City Council to retain the same general plan of
government under which it is currently organized, to wit: the Mayor -Council plan,
but to be governed by Chapter 35A.12 RCW (Mayor -Council) of the Optional
Municipal Code.
Section 3. That the city clerk is hereby authorized and directed to publish this resolution at least
once within ten (10) days of the resolution's passage.
Section 4. That if no timely and sufficient referendum petition has been filed, as is provided for
in Section 35A.02.035 RCW, within ninety (90) days of the first publication of this
resolution, excluding the date of first publication, the City Council shall by ordinance
adopt for the City of Port Orchard the classification of "Non -charter code city" under
the Mayor -Council plan of government.
PASSED by the City Council of the City of Port Orchard, SIGNED by the Mayor and attested
by the City Clerk in authentication of such passage this 28th day of March 2017.
