A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, AUTHORIZING
THE MAYOR TO EXECUTE SUPPLEMENT NO. 2 TO CONTRACT NO C071-16 WITH
BERGER ABAM, INC. FOR THE TREMONT STREET WIDENING PROJECT -
CONSTRUCTION PHASE (FINAL AD READY PS&E, ENVIRONMENTAL PERMITTING
AND CONSTRUCTION ADMINISTRATION/MANAGEMENT) AND DOCUMENTING
ARCHITECTURAL & ENGINEERING SERVICES PROCUREMENT PROCEDURES
WHEREAS, pursuant to RCW 39.80, the City of Port Orchard's Public Works Department
annually publishes the general Request for Qualifications (RFQ) for professional engineering,
surveying, architecture, structural design and related services for the Professional Services
Roster and on June 3, 2013 the City of Port Orchard transitioned to the MRSC Consultant Roster
database, but still publishes annually the general Request for Qualifications (RFQ) for the
Professional Services Roster; and
WHEREAS, between June 30, 2016 and August 18, 2016, and as documented within
Resolution No. 067-16, the City of Port Orchard Public Works Department selected the Berger
Abam/Exeltech Project Team for the Tremont Street Widening Project - Construction Phase
(Final Ad Ready PS&E, Environmental Permitting and Construction Administration/
Management); and
WHEREAS, on August 23, 2016, the City Council approved Contract No. C071-16 for the
Tremont Street Widening Project - Construction Phase (Final Ad Ready PS&E, Environmental
Permitting and Construction Administration/Management), but only authorized the funding
amount (which included a Management Reserve Fund) needed for the Final Ad Ready PS&E and
Environmental Permitting portion of the Contract; and
WHEREAS, on November 11, 2016, the Management Reserve Fund was released via
Supplement No. 1; and
WHEREAS, on March 28, 2017, pursuant to negotiations held between the Berger
Abam/Exeltech Team and the City of Port Orchard (with WSDOT Highway & Local Programs
support), the City received the Supplemental Agreement No. 2 proposal for the Construction
Administration/Construction Management phase of the Contract, including a time extension to
December 31, 2019; and
WHEREAS, the Port Orchard City Council, at the 2015 recommendation of the State
Auditor's Office, wishes to document their consultant selection process as described above for
this particular contract by Resolution; now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES
AS FOLLOWS:

THAT: The Port Orchard City Council adopts Resolution No. 015-17, thereby
approving Supplement No. 2 to Contract 071-16 with Berger Abam, Inc., for the
Tremont Street Widening Project - Construction Phase (Final Ad Ready PS&E,
Environmental Permitting and Construction Administration/Management) and
adopts the "Whereas" statements contained herein, as findings in support of the
City's consultant selection procurement procedures.
PASSED by the City Council of the City of Port Orchard, SIGNED by the Mayor and
attested by the Clerk in authentication of such passage this 25th day of April 2017.
